All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Mourning DRAKE (1754-1809), will dated 3 Oct 1806, presented 21 Aug 1809, proved 21 May 1810 I Mourning Drake of Southampton County Virginia being weak of body, but of sound mind and memory knowing the uncertainty of this transitory life, do think proper to make this my last will and Testament, in manner and form following to wit - First_ I give devise and bequeath to my Sister Sarah Powell the sum of one dollar to her and her heirs and assigns forever~ Second_ I give divise and bequeath to my Brother Exum Drake the sum of one Dollar to him and to his heirs and assigns forever - Third_ I give divise and bequeath to my Brother Simmons Drake the sum of one Dollar to him and to his heirs & assigns forever- Fourth_ I give divise and bequeath to my Nephew Abraham Jincken the sum of one Dollar to him and to his heirs and assigns forever Fifth_ I give divise and bequeath to my Sister Mildred Drake the sum of one Dollar to her and to her heirs and assigns forever Sixth_ I give divise and bequeath to my sister Martha Drake all my Plantation Lands, whereon I now live, during her life; and after her death; to my niece Sarah Powell to her and to her heirs and assigns forever~ Seventh_ I do hereby nominate, Constitute, and appoint my sister Sarah Powell to be executor to this my last will and Testament and I do hereby revoke and disanul all other wills by me heretofore made ratifying & Confirming this and no other to be my last will and Testament, In Witness whereof I have hereunto set my hand and seal this third day of October one Thousand eight hundred and six. Washington Mary (hermark) Drake At a Court held for the County of Southampton the 21st day of August 1809_ This Will was presented in court by Sarah Powell the executrix therein named proved by the oath of Zebulon Washington one of the witnesses thereto and Continued_ and on the motion of the said executrix who made oath according to law the same is granted her on giving Security whereupon &c. And at a court held for the said County the 21st day of May 1810 this will was further proved by the oath of Mary Drake the other witness hereto and is ordered to be recorded_ Saml.
