James GARNER, will, dated 9 Oct 1747, proved 8 Aug 1754 

James Garner's  In the name of God Amen the 9th. Day of October in the 
   Will         year of our Lord 1747 I James Garner being week in body 
                but of Perfect mind and memory thanck's be given unto 
                God therefore Calling unto mind the Mortality of my Body 
                and knowing that it is appointed for all men once to die do 
                make and ordain this my Last will and Testament and 
                first of all I give and Recommend my Soul into the hands 
                of God that gave it. and for my body I Recommend it to 
                the Earth to be Buried in a Christian like and Decent 
                manner at the Discretion of my Executors nothing Doubting 
                but at the General Resurrection I shall Recieve the same 
                again by the mighty power of God and as touching such 
                world'ly Estate wherewith it hath Pleased God to bless me 
                with in this Life I Give and Dispose of the same in the 
                following manner and form first of all I give and Bequeath 
                unto my Dearly beloved Son Jame Garner five Shilling 
                Secondly I give and Bequeath unto my Dearly beloved Son 
                Joshua 97 Acres of Land  being a Patent Granted by his 
                honourable Alexsander Sotswood on the west side of the 
                foxtrop brance in Nancemond County and my Negro Fellow 
                Cesar to him and his Heirs for ever  thirdly I give and 
                bequeath unto my Dearly beloved Son John all the Lands that is 
                of the Northwest side of the Indian branch to the middle of the 
                Spanish oak Land and Negro Rose to him and his Heirs forever 
                fourthly I give and bequeath unto my Dearly beloved Son Matthew 
                the Plantation that I now live upon and all the Lands within 
                the Indian branch Adjoining to Joshua's  Fifthly I Give unto 
                my Son in Law John Lawrance five Shillings  Sixthly I Give 
                unto my Daughter Penelope my Little Negro Jubiter to her and 
                her heirs  ~

                Negro Cate to him and his Heirs  To my Dearly beloved 
                Wife I Leave her the Work of my Negro fellow Cesar and 
                Rose and Jupeter to her as Long as She Lives a Widow and 
                after Death ot time of Marriage for my Children aforesaid 
                for to take them and all the Rest of my hole Estate for to be 
                Equally divided after their Mothers death or marriage only 
                Leting her have the use of it tell then and at the Day of Death 
                or marriage then for to be Equally Divided between Joshua, John 
                Matthew, Penelope, Juda  I Leave my Son in Law James Vick 
                and my Son Joshua Garner my hole Executors  to at [act] and do 
                as they think fit for to Every one alike and I do hereby utterly 
                Disallow revoke all and every former Testament by me in 
                any ways before this time named willed and bequeathed and 
                Confirming this and no other to be my Last will and Testament. 
                In witness whereof I have hereunto set my Hand and Seal 
                the Day and year above Written

              Day of August 1754 
              This Will was Presented in Court by James Vick and Joshua 
              Garner the Executors herein named proved by the Oaths of Thomas 
              Sharp, Carr Dardan & John Garner the Witnesses thereto And on 
              the Motion of the said Executors who made Oath according to Law 
              Certificate is granted them for obtaining a Probat hereof 
              giving Security
