Item- I give and bequeath unto my son Jesse Gardner one Negro boy named Tomey(?), one gray mare and thirty Pounds cash unto him and his heirs forever. Item- I give and bequeath unto my daughter Lydia Joyner five Shillings unto her and her heirs forever. Item- I lend unto my beloved Wife Ann Gardner all the remainder part of my whole estate during her life or Widowhood to raise and bring up the children upon. Item- I give unto Daughter Milley Gardner, 1 Negro boy named Charles unto her and her heirs forever. Item- I give and bequeath unto my son John Gardner one hundred acres of land bought of Wm. Worrel lying the south side of the (?)prong of Nottoway and one Negro girl named Edy, unto him and his heirs forever. Item- I give and bequeath unto my daughter Ann Gardner, one Negro girl named Sylvia unto her and her heirs forever. Item- I give and bequeath unto my son James Gardner one Negro man named Jupiter unto him and his heirs forever. Item- I give and bequeath unto my daughter Mary Gardner one Negro woman named Rose unto her and her heirs forever. Item- I give and bequeath unto Pheby Gardner one Negro woman named Jude unto her and her heirs forever. Item- I give and bequeath unto my son Amos Gardner my manner Plantation unto him and his heirs forever. Item- And after the decease or marriage of my beloved Wife Ann Gardner the remainder part of the whole estate as to be equally divided between the children as namely, Jesse Garner, Milley Garner, John Garner, Ann Garner, Mary Garner, Phebe Garner, James Garner, Amos Garner, unto them and their heirs forever. Item- I do appoint my sons Jesse Garner and John Garner my whole and sole executors of this my last Will and Testament disannulling and revoking all other contingent writings, Will or Wills claims or demands. VIRGINIA In the name of God Amen---I Joshua Gardner of S ton(abbreviation for Southampton?) County Virg. Being perfect in health and sound in mind and memory recalling to mind the Mortality of my body and knowing it is appointed for all to die do make and ordain this my last will and Testament. Principally and first of all I recommend my soul into the hands of Almighty God who gave it and any body to the earth to be entered decently at the discretion of my errors and touching such worldly Estate as it hath pleas’d God to bless me with. I give in the following manner. Item- I give to my loving wife Ann Gardner six neg.(?negroes?)Easar, Peter, Sam, Pat, Hannah and Lucy during her natural life to raise and school my children or and after her death the above named neg. to be equally divided amongst all my surviving children Henry, Jno., James, Jasper, Ann, Betsy, Rhoda, Polly D. and Peggy Gardner to them and their heirs forever. Item- I give unto my son Henry Gardner, the land with the appurtenances that I bought of Moses Darden lying on Cedar Swamp containing one hundred and seventeen acres and one hundred acres lying on the east side of Cypress Swamp. Also one neg. boy name Arthur to him and his heirs forever.--- Item- I give unto my son Jno. Gardner the land I bought of Moses Darden lying on the Cypress Swamp as follows one tract of land containing two hundred and forty nine acres lying on both sides of the said Swamp and one tract adjacent thereto lying on sd. Swamp containing fifty three acres with the appurtenances. Also my will and desire is to have a house built on the said tract of land twenty eight feet by fifteen with a partition through it one half plank floor and the other half dirt, one brick chimney at each end, to be built out of the estate left my wife. Also one negro boy named Andrew. One bed and furniture, one chest, two black walnut chairs and two maple ditto, one dish, one bason, four pewter plates and three spoons and three earthen plates, one iron pot, one horse bridle and saddle, two cows and calves, three sows and piggs, five ewes and lambs to him and his heirs forever. Item- I give unto my son Jesse Gardner one tract of land I bought of Matthew Jones lying on the fourth side of Blackwater, beginning at the mouth of the Cedar Swamp thence up the various courses of the said swamp to John McCabes line thence down the said line to Blackwater thence down the same to the beginning containing forty acres more or less. One negro man nam’d Pompey, I desire at my death, to be hired out until the said child becomes of lawful age and the money arises therefrom to be appropriated to the use of the said child to school him and after he becomes of lawful age to take this s’d. neg. man in possession forever. Also one neg. girl nam’d Amy, one bed and furniture, one chest, two black walnut chairs, two maple ditto, one dish, one bason, four pewter plates, three spoons and three earthen plates, one iron pot, one horse, bridle and saddle, 2 cows and calves, 3 sows and piggs, 5 ewes and lambs, to him and his heirs forever. And in case either of the brothers should die under age my desire is that his land should be equally divided amongst his other brothers then alive. Item- I give unto my daughter Ann Jones one neg. girl nam’d Rose to her during her life and after her death to all her children then alive to them and their heirs forever. Item- I give unto my daughter Betsy Carr one negro girl nam’d Patience to her and her heirs forever. I give unto my daughter Rhoda Gardner one negro girl nam’d Sciley, one bed and furniture, one woolen wheel, one chest two black walnut chairs, two maple ditto, one dish, one bason, one iron pot, four pewter plates, three spoons and three earthen plates, one womans saddle, two cows and calves, three sows and piggs, five ewes and lambs to her and her heirs forever. Item- I give unto my daughter Polly Darden Gardner one negro girl named Milly and twelve pounds current money of Virginia. One bed and furniture, one woolen wheel, one chest, two black walnut chairs, two maple ditto, one dish, one bason, four pewter plates, three spoons, three earthen plates, one Iron pot, one womans saddle, two cows and calves, three sows and piggs, five ewes and lambs to her and her heirs forever. Item- I give to my daughter Peggy Gardner one Negro girl named Chaina, one bed furniture one chest two black walnut chairs, two maple ditto one woolen wheel one dish one bason four pewter plates three spoons three earthen plates one Iron Pot one womans saddle two cows and calves three sows and piggs five ewes and lambs to her and heirs forever. And in case either of the daughters should die without a lawful issue my will and desire is that her legacy should be equally divided amongst my children then alive--- Item- I give to my loving wife Ann Gardner the use of my plantation and land whereon I now live and all the residue of my Estate of what kind or quality whatsoever during her natural life my will and desire is that my Estate may be kept together with my wife untill my children eventually come of age to receive there legacies as above mentioned and my desire is my estate may not be appraised but only an inventory returned- I hereby nominate and appoint my wife Ann Gardner Executrix and my son Henry Gardner Executor to this my last will and testament revoking all other wills by me before made Ratifying this and no other to be my last will and testament. In witness whereof I have set my hand and affixed my seal this 4 day of February 1793. JOSHA GARDNER-seal Signed Sealed and pronounced in the presence of Jacob Darden Sr. Jacob Darden Jr. Jonathan Darden. At a Court held for the County of Southampton the 12 day of December 1793. This will was presented in Court by Ann Gardner and Henry Gardner the executors therein named and proved by the oaths of Jacob Darden Sr. And Jacob Darden Jr. Witness thereto and ordered to be recorded and on the motion of the said Executors who made oath according to law certificate is granted them for obtaining a probate thereof in due form giving security whereupon. Sam Kello Ec. ****************************** 1802 WILL OF JESSE GARDNER; W.B.#5, PGS. 367-368 I, Jesse Gardner, ?? of Southhampton County Virginia being in good health and sound mind and memory, but calling to mind the mortality of my body do make and order this my last Will and Testament in manner and form following to wit. ???????- I leave to my loving wife Elizabeth Gardner, the full use of my land and plantation during her life- I also leave the three Negroes to wit, two boys Aaron and Amos and girl Asia, during her life. Item- I give to my son Joshua Gardner, five Shillings cash. Item- I give to my daughter Salley Gardner, one Negro girl, Letia to her and her heirs forever. Item- I give to my son John Gardner, five Shillings cash and one Negro boy, Alexander to him and his heirs forever. Item- I give to my daughter Elizabeth Gardner, five Shillings cash. Item- All the residue of my estate of every kind whatsoever after my debts are paid I leave the use thereof to my wife during her life- And at her death, I give the same as ???? as the land and three Negroes mentioned in the first Item-to be equally divided amongst my four youngest children- Jeremiah, Robert,Jesse and James, to them and their heirs forever. Lastly- Thereby nominate and appoint John Lee and Jacob Dardin, ??? Executors to this my last Will and Testament ratifying and confirming this and no other to be my true last Will and Testament ???
