SOUTHAMPTON COUNTY, VA - WILLS AND ESTATES - Daniel Hutchings, 27 May 1756 --------------¤¤¤¤¤¤-------------- Will: Daniel Hutchings, Norfolk Borough, Southampton Co, VA(1782) IN THE NAME OF GOD AMEN, I Daniel Hutchings of Norfolk Borough, being in health of body and of sound mind and memory do make and ordain this my last will and testament in manner and form following: Imprimis: I give and bequeath to my loving wife Elizabeth Hutchings the use of one half of my estate, real and personal, during her natural life. Item: In case my said wife is with child, I give to first child the other half of my estate, real and personal, and to his or her heirs forever and I also give the half of my estate already given to my wife for life after her death to such child and his or her heirs forerver. But if such child shall die before it shall arrive to the age of twenty one years & before marriage, then I give the use of the half of my estate given to my child to my loving wife Elizabeth during her natural life & after her death and in case of the death of my child before age and marriage, then I give the reversion and reversions of my whole estate, real and personal, to my brother Robert Moseley, alias Hancock, and his heirs forever and in case of the death of my said brother in the life time of my said wife, then I give the reversion and remainder of my estate to such person or persons as shall legally represent my said brother & to their heirs forever. And I do appoint my loving wife Elizabeth & my brother in law Thomas Milson Executrix & Executors of this my Last Will and Testament hereby revoking all former Wills by me heretofore made. IN WITNESS whereof I have hereunto set my hand and affixed my seal this twenty seventh day of May in the year of our Lord one thousand seven hundred and fifty six. In case there out estate a nuf to pay my debts in that case to be sold if my wife chuseth rather than the negroes or furniture. In case the land should be sold, my wife must give my brother Robert Mosley security for one hundred pounds, she having the use of it her life time. In case she should dy before me to his children my whole estate at the death of my wife given under my hand March 1766 Daniel Hutchings (seal) Witness: William Godfrey John Livington At a Court held for the County of Southampton the 13th day of June 1782 This Will was presented in court by Elizabeth Hutchings, the Executrix therein named, proved by the oaths of Ann Miller, one of the witnesses thereto and continued for further proof, and on the motion of the said Executrix, who made oath according to law, Certificate is granted her for obtaining a Probat thereof in due form giving security whereupon &c. And at a court held for the County of Southampton the 11th day of July 1782 Alexander Guthrie offered as a witness to prove the handwriting of the said Daniel Hutchings deceased, who being sworn deposeth that he served the said Hutchings ten years as a captain of a packet from Norfolk to Burwells Ferry, that he was well acquainted with the said Hutchings handwriting and that he verily believes the codicil to be the Will of the said Daniel Hutchings proved at the last court was wholly written and subscribed by the said Hutchings and that a letter now filed to prove the similarities of handwriting by the diposition of Alexander Guthrie is ordered to be recorded, and on the motion of William James who made oath according to law, Certificate is granted him for obtaining letters of administration by Elizabeth Hutchings, deceased, the former Executrix, with the said Will annexed giving security whereupon &c.
