Persons or organizations desiring to use this material, must obtain the written consent of the contributor, or the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ************************************************************************ Submitted by Helen Pate Ross ************************************************************* I, JOHN IVY, of the county of Southampton being weak of body but of sound and disposing sense and mine thanks be to the Almighty God for the same do make and ordain this my last will and testament viz: After my funeral expenses are defrayed and just debts paid, I dispose of my worldly goods both real and personal which it hath pleased God of his infinite mercy and goodness to cast on me in the following manner (to wit): I lend to my beloved wife ELIZABETH IVY during her natural life the feather bed whereon she generally llies and the furniture thereunto belonging. Her side saddle and my smallest iron pot. I give and bequeath tomy daughter PRISCILLA BULLOCK a bed which she calls her own & her inheirship. I give and bequeath to my son JAMES IVY a part of my land lying on the southside Great Poughman Swamp being the north part of my tract of land whereon I now live and divided from the South part there of by a line of marked trees which I made last week in presence of my neighbor THOMAS PATE and EDWARD PATE the said live begins at a ford & a red oak in the line that divides JOHN REESES land from mine and runs near a southwest curve to a red oak and elder tree in the line that divides AMBROSE GRIZZARD land from mine containing estim'd 103 acres be the same more or less to him the said JAMES IVY and to his his heirs forever. I give and bequeath to my son JOHN IVY and to his heirs forever all the remainder part of my land lying between the name lline above mentioned and the Little Poughman swamt containing a estem'd 103 acres be the same more or less. I desire all the remainder part of my estate in whatsoever manner it lyeth or may be found to be sold for ready money and the money arising from the sale thereof to be equally divided between my wife ELIZABETH IVEY and my children DAVID IVY, ANNE MORGAN, PRISCILLA BULLOCK and REBECCA IVY. I desire my estate not be appraised. I do constitute and appoint my beloved friend JOSHUA NICHOLSON my whole and sole executor of this my last will and testament in witness whereof I have here unto set my hand and affix my seal this fourth day of March 1780 signed sealed and published and declared by the said JOHN IVY as his last will in presence of THOMAS PATE, EDWARD PATE JOHN IVY seal WILLIAM PATE. At a court held for the county of SOUTHAMPTON the 12 day of April 1781. This will was proved by the oath of THOMAS PATE & EDWARD PATE two of te witnesses threto and ordered to be recorded.
