JOYNER, will dated 30 Apr 1870, proved 20 Feb 1871 I James R. Joyner of the county of Southampton and state of Virginia do make and ordain this my last will and testament hereby revoking all former wills made by me in manner and form following: 1st: I wish my executors who I shall hereafter name as soon after my death as he may think best sell all of my chatteled estate pay my just debts. 2nd: I lend to Mary Joyner colored during her natural life or while she may remain unmarried one third part of my estate of every kind whatsoever and at her death or marriage I give the same to her children say Richard W. Joyner, Mary W. Joyner, Elizabeth A. Joyner, Junius Joyner, Martha A. Joyner, William A. Joyner, and Luther Joyner to be equally divided betwem them to them and their heirs forever. 3rd: I give the balance of my estate of every kind whatsoever to the following named persons (children of the said Mary Joyner colored) to wit: Richard W. Joyner, Mary W. Joyner, Elizabeth A. Joyner, Junius Joyner, Martha A. Joyner, William A. Joyner, and Luther Joyner all of which I give to them equally to them and their heirs forever. 4th: I do hereby constitute and appoint Ben E. Pope my executor. In witness whereof I have hereunto set my hand and affixed my seal this 30th day of April 1870. James R. Joyner Witnesses: George R. Branch Benjamin M. Goodwyn At a court held for the county of Southampton on the 20th day of February 1871 this last will and testament of James R. Joyner deceased was proved by the oaths of George R. Branch and Benjamin M. Goodwyn the subscribing witnesses thereto and ordered to be recorded and Ben E. Pope the executor therein named refusing to take upon himself the burden of the execution thereof and no person applying for administration on this estate, and the said James R. Joyner being dead more than three months, it is ordered that William W. Briggs, sheriff of the county, take the estate of the said James R.
