All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Kinchen JOYNER, will, devised 11 Apr 1836, proved 19 Apr 1841 K Joyner Will In The name of God amen I Kinchen Joyner of Southampton County Virginia being in perfect sense and memory do make this my last will and Testament to wit: I leave unto my beloved wife, Agga all the profits and Emoluments of my real and personal estate during her life but after her death I devise it in the following manner. (1.st) I give and bequeath unto my daughter Polly my dwelling house and part of my plantation, (Viz) beginning at a spruce pine a Corner in the line of James Scott thence Scotts line to Browns road and up said Road to the Oberry church land and by said Church land to a red Oak a Corner in Joseph Pretlows line from thence a straight line to the first station with the privilege of getting fire wood and rail Timber from my pocoson Land also one feather bed and furniture One Loom and gear One Blue Chest and one pine table to her and to her heirs and assigns forever. (2.d) I give and bequeath unto my son William Joyner the remainder of my land with the exception of the aforementioned privileges to my daughter Polly _ (3.d) I give and bequeath unto the heirs of my son Joshua Joyner the sum of One dollar each, to them and their heirs or assigns forever. Lastly. I wife Agga to be my sole Executrix and after satisfying all my just debts to keep the remainder of my estate during her life and after her death to be equally divided between my aforementioned son and daughter William and Polly. Given under my hand and seal this 11th day of April One thousand eight hundred and thirty six ___ Elijah Joyner his Kinchen Joyner ĪsealĪ James + Joyner mark Joseph Pretlow At a Court held for the County of Southampton the 19th day of April 1841 The last will and Testament of Kinchen Joyner deceased was proved by the oath of Elijah Joyner and James Joyner two of the subscribing witnesses thereto and ordered to be Recorded and Agga Joyner the executrix therein named refused to take upon herself the burthen of the execution thereof. On motion of William Joyner who made oath and together with Polly Joyner Exum Turner and James Joyner his securities entered into and acknowledged entered into and ackno= =wledged a bond in the penalty of five hundred dollars Conditioned as the law directs Certificate is granted him for obtaining letters of administration on the estate of the said Kinchen Joyner with his said will annexed in due form. Benjamin Joyner (son of a William), 12 Jan 1842; sec/wits Wiley Joyner, L.R. Edwards, Elihu Joyner & Thomas Drake. Polly/Polley Joyner m. Archibald "Baldy" Mumford/Munford/Mountford/Mountfort, 2 Nov 1848. William Joyner & Mary his wife sold his 30-acre tract to Polly, 20 Sep 1841. (DB25:187-88) A year later, 14 Nov 1849, Baldy & Polly sold the a 70-acre tract to Thomas H. Drake, for $210. Six weeks later, 28 Dec 1849, Thomas sold it back, for $215 (DB27:459-60; 512-13). Baldy Mountford & Polly his wife sold 78 acres to John Pretlow, 10 Feb 1860. This included the 45 acres given to Polly, and 33 acres she bought from her brother William Joyner. (DB29:559) William Joyner (of Kinchen) & Diza his wife, of Nansemond Co., sold 2 tracts- one of 48 acres, the other of 14 acres, to William Brantly, 19 Mar 1855. (DB28:600) Polly, the wife of Baldy Mumford, still retained her right to firewood & fence-rail timber as "bequeathed to her in Kinchen Joyners Will" when William Brantly & wife Mary sold the "Pocoson piece" to Jincy Brown, 4 Jan 1862.
