SOUTHAMPTON COUNTY, VA - WILLS - Margarett (POND) JOHNSON, 8 Dec 1898 ----¤¤¤---- [p.] 38 [...] [margin note] Ex. Mrs. Margarett JOHNSON's Will In the name of God Amen. I Margarett JOHNSON of the County of Southampton, & State of Virginia, being in sound mind and disposing memory do make, constitute and ordain this writing, as and for my last will and testament, in the manner and form following to wit. After my death it is my will and desire that my executor hereafter named, shall sell to the best advantage the plantation whereon I now reside, being the same given me by my husband in his last will, & make a deed to the purchaser for the same, also sell my chattel estate, not otherwise disposed of and collect all due me, and out of the money arising from such sale & collection, after the payment of all my debts, distribute in the following manner. Item 1st _ It is my will and desire that my executor retain in his hands twenty-five dollars to be applied to Keepind [sic; erroneous "d" underlined] the grave yard well fenced and otherwise cared for. Item 2nd. Also fifty dollars to be retained by same either for the support of the pastor of Johnson's Grove Church, or for repairs of the house of worship. Item 3rd. I, give & bequeath to Japan Foreign Mission Station twenty five dollars. Item 5th. [sic] I give to Laura L BRADSHAW's four children, Flora, Carrie, Mary, & Zachra, five dollars each Item 6th I, give to Jeptha W JOHNSON one hundred dollars, Item 7th I give to Nancy R WORRELL, or her bodily heirs (& not to come into the hands of her husband) one hundred dollars. Item 8th I give to Margarett J BULLS twenty dollars. Item 9th I give to Thomas R POND one hundred dollars. Item 10th I give to William H POND one hundred dollars. Item 11th I give to Geo. W. POND one hundred dollars. Item 12th I give to Jeremiah POND one hundred dollars. Item 13th should I live to consume my estate from sickness, or otherwise, so there is not enough to pay to each of the objects & persons the amounts [page break] [p.] 39 herein named they are to be reduced according to the amounts named, and should my effects sell for more than enough to pay the amounts named, then the surplus is to be divided in the same proportion to the amounts given. Item 14th It is my desire & Will at the sale of the Land named, that that portion of the grave yard enclosed shall be forever exempted. Lastly I hereby nominate and appoint my friend Jeptha W JOHNSON, as my sole executor, to carry into effect this my last will and testament, hereby revoking all other wills heretofore made by me, In testimony whereof, I have hereunto set my hand & affixed my seal this 8.th day of December (1898) eighteen hundred & ninety-eight. A writing purporting to be the last will and testament of Margarett JOHNSON deced. was produced in Court, and proved by the oaths of E.J. RAIFORD and W.G. RAIFORD, the subscribing witnesses thereto, and ordered to be recorded, And on the motion of Jeptha W. JOHNSON, the executor therein named, who made oath according to law, and together with Thomas R. POND and Geo W POND as his securities, who ["made" struck through] Justified on oath as to their sufficiency, entered into and acknowledged a bond in the penalty of twenty-five hundred dollars, conditioned as the law directs, which bond is ordered to be recorded, Certificate is granted the said Jeptha W. JOHNSON, for obtaining a probate of the said will in due form, and on the motion of the said executor Allen BEALE John D. DAVIS and J.W.
