All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Daniel POND (1714-1785), will dated Dec 1785, proved 9 Feb 1786 In the Name of God Amen I Daniel Pond in the Parish of Nottoway and County of Southampton being in Health and of sound mind and memory do make and ordain this as and for my last will and Testament revoking and Disannuling all former Wills before by me made In manner & form following Imprimis I Give and bequeath unto my loving wife Mary Pond one bed and furniture likewise Two cows and calves at her own disposing I give the use and labour of my negro Anike and my plantation her life to her during~ Item I give and bequeath unto my son John Pond my lands I now live on Containing by Estimation Two hundred and Twenty three acres for which he shall be accountable to my estate for at Twenty five pounds per hundred it being part of his proportion of my estate to him and his heirs forever ~ Item my will and Desire is that the Remainder of my Estate both Real & personal be sold and Divided into Seven Equal Divisions: One Seventh part to my Son John Pond he giving Credit for the sum of of value of the lands above mentioned to him and his heirs ~ Item I Give and bequeath unto my son Richard Pond one Seventh Part of my estate's Value he giving credit to my estate for Two hundred and Seventeen acres of land at twenty five pounds Pr. hundred as much of his seventh part recivd. to him and his heirs forever ~ Item I Give and bequeath unto my Daughter Elizabeth Morris One Seventh part of my estate's Value She giving Credit to my Estate for Seventy five pounds the Value of a Negro Named Dinah which She has recd. to her and her heirs forever ~ Item I Give and bequeath unto my Daughter Mary Wood one Seventh part of my Estate's Value she Giving credit to my estate for sixty five pounds for one negro named Amy which she hath received to her and her heirs forever ~ Item I Give and bequeath unto my (son Daniel Pond's) Surviving Children one seventh part of the Value of my Estate to be Equally Divided between them and their heirs forever ~ Item I Give and bequeath unto my (Son Saml. Pond's) Surviving Children one Seventh part of my estate's Value to be equally Divided between them and their heirs forever ~ Item I Give and bequeath unto my Loving wife Mary Pond one Seventh part of my estate's Value to her Own Disposing ~ I do hereby Constitute and appoint my sons John Pond and Richard Pond my Whole Sole Executrix [sic] to this my last will & Testament and Devise that they may sell at publick Sale my whole estate as above mentioned and the Sums arising they may Divide into the Several Divisions Setling the Credits as above Mentioned my desire is that my Executrix may reserve the Different sums for my orphan Grandchildren until they come of age to receive it the principal sums paid without Interest I mean: In Witness whereof I have hereunto set my hand and seal this day of Decr.. 1785 ~ Daniel (hismark) Pond (sl) Signed Sealed Published &. } Declared by the Testator to be} his last will & Testament ~ } before us ~ } Richard Pond Elizabeth Pond Sarah Pond Be it known unto all men by these Presents that I Daniel Pond of Southampton have made and Declared that my last will & Testament in Writing Bearing date as within I Daniel Pond do my these presents containd in this codicil or Scedule Confirm and ratifie my said last will and do give and bequeath to my Son John Pond the Good and chattles he made over to me in consequence of my being security for him which stands on record, In the above County Court to him & his heirs forever he having Discharged me by paying the bond and my will and meaning is that this Codicil or scedule be estemed and Adjudged to be part of my last will and that he and his heirs and assigns may hold the Goods and chattles as before in Reasonable and Quick Possession In witness whereof I the said Daniel Pond have hereunto set my hand and Seal this Tenth Day of Decr_ 1785~ Daniel (hismark) Pond Signed Seal'd and Delivered} in Presence of us ~ } Richd. Pond Elizabeth Pond Sarah Pond ~ At a court held for the County of Southampton the 9th day of Feby. 1786. This Will with a Codicil was Presented in Court by John Pond and Richard Pond the executors therein named And proved by the Oaths of Richard Pond Elizabeth Pond and Sarah Pond witnesses thereto and Ordered to be recorded.
