All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Mary POND (1715-1799), will dated 19 May 1798, proved 15 Apr 1799 In the name of God Amen, I Mary Pond (the Eldest) being of Sound mind and memory do make and ordain this my last Will and testament hereby revoking and disannulling all other Wills heretofore by me made-- First, I desire that my daughter Mary Wood shall have my Chest, to whom I give it forever-- Second, I give and bequeath to Mary Pond, (Wife of my Grandson John Pond jr.) my small Bed and furniture, to her and her heirs forever-- Third I desire that all my other property, after my Just debts, and Funeral Expenses are paid; shall be equally divided amongst my son John Pond, my daughter Mary Wood and the Children of my deceasd. son Richard Pond, they the said Children of my son Richd. Collectively, to draw but one third, & my son John & daughter Mary Wood the other two thirds of my Estate; On Condition however to my Son John, that if he should bring any account or Claim of any kind against me; I in that Case desire, that he shall not have, enjoy or possess any part of my Estate, but that the whole, except what I have given to my daughter Mary & the wife of my grandson John, shall be equally divided between my daughter Mary Wood she to have one half and the Children of my decd. son Richd. Collectively (they to have the Other half) To whom I give it forever-- and moreover, I desire, that if my son John should bring any charges or claim against me, that he should be charged for the use of the plantation whereon he lives, to which I have always been entitled to a Life right; but in Case my Son John shall not bring any Claim against me, I give him one equal Third part to him and his heirs forever and I desire to (to effect an equal division) all my saleable property except such as I have other wise given away, shall be sold to the highest bidder for ready money. Lastly I Constitute and appoint my good friends John H.
