All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ James PORTER (1730-1794), will dated 6 Oct 1791, proved 11 Dec 1794 In the name of God Amen I James Porter being in my Perfect & sense & memory do make this my last will & testament in manner & form as followeth Imprimis I lend unto my loving wife Ann Porter the tract of land whereon I now live containing two hundred & fifty acres & two negros namely Peter & Jinny during her natural life or widowhood. Item I give and bequeath unto my son Jacob Porter the tract of land whereon he now lives containing two hundred &one Acres & three Negro's namely Priss Simon & Isaac to his & to his heirs forever. Item I give and bequeath unto my son James Porter the tract of land whereon he now lives containing one hundred & ninety six acres & three negros namely Dick Sam & Ben to him & to his heirs forever. Item I give and bequeath unto my son Nathan Porter three Negros namely Lewis David & Tom & after my wife's death or marriage I give unto my said Son Nathan the tract of land whereon I now live & also the negro Peter that I have lent to my wife all which land & negros(sic) I give to my sd. son Nathan & to his heirs forever. Item. I Give unto my daughter Edith Vick one Negro woman named Judy & her increase to her & to her heirs forever. Item I Give unto my grand daughter Priscilla Vick one negro nam'd Easter & her increase to her and to her heirs forever. Item I give unto my daughter Penina Porter one Negro nam'd Beck & her increase to her & to her heirs forever. Item I give unto my grand daughter Liddia Porter one negro girl Dorcas & her increase to her & to her heirs forever. Item I give unto my grand daughter Lucy Porter one negro girl nam'd Rhody & her increase to her & to her heirs forever. Item I give unto my daughter Polly Porter three Negros namely Dempsey Carson & Isham & one feather bed & furniture & at the death or marriage of my wife Ann I give unto my said daughter Polly the Negro woman Jinny (which I have lent unto my wife) together with her increase to her & to her heirs forever. Item After paying my just debts funeral Expenses &c. I desire that all the remainder of my estate not heretofore mention'd may remain & be in the care & Possession of my wife Ann Porter during her natural life or widowhood and at her death or marriage, I give the Same to be equally divided between my three Youngest children namely James Nathan & Polly Porters to them & their heirs or the Survivors of them. Item In case my daughter Polly Porter should die before she arrive to the age of Eighteen years or without Issue of her body, then in that case I give the Negros & other estate that I have will'd to my sd. daughter Polly to be equally divided between my sons Jacob James & Nathan Porters & their heirs or the survivors of them and their heirs forever. I do constitute and appoint my Sons Jacob Porter & Nathan Porter Executor of this my last will & Testament revoking all other wills by me heretofore made. In witness whereof I have hereunto Set my & affix'd my Seal this 6th day of October in the year of our Lord 1791. And on the motion of the said Exor who made oath according to Law certificate is granted him for obtaining a Probat thereof in due form giving Security whereupon &c.
