SOUTHAMPTON COUNTY, VA - WILLS AND ESTATES - Thomas Peete, 4 Mar 1801 --------------¤¤¤¤¤¤-------------- IN THE NAME OF GOD AMEN, I Thomas Peete of the County of Southampton do this forth day of March one thousand eight hundred and one, make and ordain this to be my last will and testament in manner and form as following (to wit): Imprimis: I leave unto my loveing wife Mary Peete during the term of her natural life the use of all my houses, gardens with one half of the land whereon I now live to be worked and tilled in a suitable manner not to be tenanted or rented out or in any other wise abused further than for her support. I also lend unto my said wife during her natural life the use of twelve slaves, vizt: Moses, Charles, Abram, Brutus, Aggy, Fanny and her daughter Amy, Lucy, Judy, Hanner, Peg and Celia. I further lend my siad wife the use of the following furniture, provided she doth pass her obligation to the gardian of any grandson Thomas Blunt for the delivery and return of said furniture at the time he may arive at lawful age and in reasonable good order (vizt): two beds and furniture compleat, six walnut chairs with hair bottoms, two four-feet walnut tables and my mahogany desk & book case. Item: I give unto my said wife Mary to her proper use four horses (vizt): Mertey, Bacon, Napared and Butt cat, also fifteen head of cattle, fifteen head of sheep, thirty head of hogs, my riding chaire & harness, one cart and wheels, three ploughs with gear thereto, three beds and furniture, one cherry desk, one four-foot walnut table, one ditto oval, one mahogany ditto, one painted pine ditto, six winsor chairs, six rush ditto, one dressing glass, one small ditto, two pair of andirons, one set of tongs and shovel, three trunks, two chests, one loom with the harness thereto, two bcotton wheels, one flax ditto, two pair cotton cards, half a dozen silver table spoons, a sufficiency of corn, wheat, meat, coffee and sugar for her support the present year. I further give unto my said wife one equal half of my table linen & napkins, silver plate, pewter, china, glass and earthen ware, sugar box, butter potts, knives & forks, flat irons, tubs and pales, trays & kitchen furniture. I also give her one third part of all such tools as are used in cropping together with one third part of my casks, barrells and brine tubs. I say the use of half of my land and plantation whereupon I now live with the lent of the aforementioned slaves together with the bequest as already made in lieu and bar, of any other or further claims or dower in or to my estate either real, personal, or in reversion which my aforesaid wife Mary may claim or in any otherwise seek for except my young yoke of oxen which I add and give unto her as confirmation of this bequest. Item: I lend to my wife Mary negro boy Bob untill my grandson Thomas Blunt arive to lawful age. Item: I give unto my grandson Thomas Blunt the sum of eighty pounds to be applied towards his education. I also give him the following slaves, vizt: Boy Isaac, girl Mollie, boy Charles & when he arrives at the age of twenty one years, I give him negro boy Bob which I have lent to my wife untill that period, also the following furniture to be delivered by my wife Mary as designated in the first clause of this my Will, vizt: two beds & furniture compleat, six walnut chairs with hair bottoms, two four-feet walnut tables and my mahogany desk & book case. I likewise give him my said grandson my silver watch, but in case he should die before the period as above mentioned, then that aforementioned slaves & the bequest of every kind, as recited are to revert and be accounted? as part of my residuary estate hereafter mentioned. Item: I give to the sons of Benjamin Peete by name: Samuel, Thomas & Benjamin Blunt Peete, the sum of six hundred & forty five pounds cash & also John Wrights bond for three hundred pounds, all of which is to be equally divided between them & immediately put out to interest. Item: I give unto my grandson Alexander Peete to him and his heirs forever the tract of land and plantation whereon I now live containing six hundred and thirty five acres, be the same more or less, but never the less one half of said land is subject to the free use of my wife during her natural life as above mentioned. I also give unto my said grandson Alexander Peete, John Wrights bond for the sum of two hundred and nineteen pounds six shillings & nine pence. Also George Blow bond for eighty three pounds fourteen shillings, and Littlebury Masons bond for fourteen pounds twelve shillings and five pence. Item: I give unto my son Benjamin Peete and his heirs, Christian and her children which he already has in possession. Item: I give unto my son Thomas Peete, to him and his heirs forever, the folowing tracts of land (vizt): the tract that I purchased of John Aplewhite containing two hundred and fifty eight and an half acres and the two tracts of land I purchased of Ephraim Ivy; one containing sixty eight acres lying in the county of Southampton and adjoining the land I purchased of John Aplewhite; the other tract lying in the county of Sussex adjoining the lands of Littlebury Mason and containing one hundred acres and also my bay colt, got by the Clock of Diamonds. Item: I desire that my slaves, horses and stock of all kinds may be kept together during the present year for the purpose of making a crop and at the close thereof to be divided as the Will directs at which time I give unto my said wife Mary one third part of all and every part of the crop that shall be made in the lands which I now possess. Item: I give the remainder and residue of my estate of whatsoever, or wheresoever found to my two sons Benjaming and Thomas Peete to be equally divided between them if practicable but in case a just and equitable division cannot be made and effected by my Executor hereafter to be named, that then he shall proceed to make sale of the said residuary estate to the highest bidder giveing account of twelve months and the money arising from said sale to be equally divided between the said Benjamin and Thomas Peete and their heirs. Lastly, I do constitute and appoint my friend Samuel Blunt Executor of this my Last Will and Testament.
