SOUTHAMPTON COUNTY, VA - WILLS AND ESTATES - Moses Phillips, 30 Sep 1789 --------------¤¤¤¤¤¤-------------- IN THE NAME OF GOD AMEN, I Moses Phillips of the County of Southampton bieng in good health at present, thanks be to God for the same, do make and ordain this writing as my Last Will and Testament in manner and form following: Imprimis: My negro man Mingo having served me faithfully & honestly I hereby manumit and set him free & give him the shoemakers and coopers tools which he now works with. Item: I give and bequeath to Mary Cocke, the wife of William Cocke of Surry, my negro girl Aggy, to her & her heirs. All the rest and residue of my estate, both real and personal and mixed or whersoever found, I give devise and bequeath to my friend Samuel Kello and to be the Executor of this my Last Will and Testament. IN WITNESS whereof I have hereunto set my hand and seal this 30th day of September one thousand seven hundred & eighty nine. his Moses X Phillips (seale) mark Signed, sealed, published & declared by the Testator in presence of: Benjamin Drew Francis Young Jr Since the making and publishing my Last Will & Testament as above expressed, Mary Cocke, the wife of William Cocke of Surry having departed this life and her child being also dead revoke tht clause in my Will in which I had given her a negro woman named Aggy and hereby give and bequeath the said negro woman Aggy and her child Betty, borne since the date of my Will aforesaid to my friend S. Kello & his heirs. I also hereby confirm & publish the aforesaid writing (except the clause hereby revoked) to be my Last Will and Testament with this codicil annexed. Haussmann Edward Griffin At a Court held for the County of Southampton on Friday the 13th day of July 1792 This Will was proved by the oath of Benjamin Drew, one of the witnesses thereto and the codicil thereto annexed by the oath of said John D. Haussmann, a witness thereto who also deposed that he heard the said Moses Phillips acknowledge this writing as his Last Will & Testament. And at a court held for the County of Southampton the 8th day of November 1792, this Will was fully proved by the oath of Francis Young Jr, another witness thereto and together with the codicil ordered to be reprded (recorded?) and on the motion of Samuel Kello, the Executor therein named who made oath according to law, Certificate is granted him for obtaining a Probat thereof in due form giving security thereupon &c.
