John SMITH, will dated 1 Jan 1780, proved 11 May 1780 

In the Name of God Amen,  The first day of January One Thousand Seven hundred & 
Eighty  I, John Smith of the County of Southampton being Sick and Weak in Body 
but of perfect Sence & Sound Memory, do make & Ordain this my last Will & 
Testament in Manner and form following. Viz. 
Imprimis, I Give unto my Wife Martha Smith the Use of my Eleven Negroes 
hereafter nam'd Viz. Ben, Siah, Sam, David, Bob, Inike, Annaia, Natt, Charles, 
Joe, Harry, until the said Slaves Arive to the Years of Thirty one, at which 
time my Will desire is that all & every of above Negroes should be Set free 
Respectively at their Arival at thirty One Years of Age 
Item, I give the use of my Negro Woman  Milly to my Wife Martha Smith  Until the 
first day of January One Thousand Seven hundred & Eighty four, at which time my 
Will & desire is that the s.d Negro Woman Milly should be set free. 
Item, I give the Use of my Negro Young dick to my Wife Martha Smith Until the 
first day of January One Thousand Seven hundred & Eighty Seven, at the 
Expiration of which time my Will & desire is that the said  dick should be set 
free. 
Item, I give my Wife Martha Smith the Land & plantation whereon I now live with 
all the Apurtenances thereunto belonging Likewise a Tract of Land I Bought of 
Benjamin Holliman) to her & her heirs forever, I likewise Give to my Wife Martha 
Smith all the Residue of my Estate be it of What Nature or kind soever  to her & 
her heirs forever, 
Item, I likewise Constitute & appoint my Wife Martha Smith & Joshua Bailey my 
Whole & Soul Executrix & Ex.r of this my last Will & Testament  Revoking and 
making void all & every other former Will heretofore by me made, 
In Witness whereof I have hereunto Set my hand & affixed my Seal  the Day and 
year above Written                                     John Smith  ĪSealĪ 
Signed Sealed published & delivered} At a Court held for the County of 
 to be the last Will & Testament of} Southampton the 11.th day of May 1779 [*80] 
the abve named John Smith in the   } This Will was presented in Court by Martha 
presence of  .    .    .    .      } Smith & J. the Executrix & Exec.r therein 
            Benj.a Bailey            named & proved by the Oaths of Benj.a 
            Micajah Holliman         Bailey & Micajah Holliman the Witnesses 
                                     thereto & Ordered to be Recorded  And on 
                                     the motion of s.d Executrix & Exe.r who 
                                     made oath according to law Certificate is 
                                     granted them for obtaining a Probat in due 
                                     form Giving Security whereupon &c
