SOUTHAMPTON COUNTY, VA - WILLS AND ESTATES - William Suter, 28 Apr 1795? --------------¤¤¤¤¤¤-------------- IN THE NAME OF GOD AMEN, I William Suter of the County of Southampton & state of Virginia being very sick & weak in body but of perfect sound memory, thanks be given to God, calling unto mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last will & testament, that is to say: Principally and first of all, I give & recommend my soul into the hands of almighty God that gave it & my body I recommend to the earth to be buried in decent christian burial at the discretion of my Executors, nothing doubting but at the final resurrection I shall receive the same again by the mighty power? of God, and as touching such worldy estate wherewith it hath pleased God to bless me in this life, I give, demise & dispose of the same in the following manner & form: First, I give and bequeath unto my sister Rebecca Suter one hundred & fifty pounds Virginia money to be paid her at or before the expiration of three years out of my estate. Also I give to my brother Henry Suter seventy five pounds Vin? to be paid him at or before the expiration of three years. Also I give to my brother John Suter the sum of twenty five pounds V___ to be paid him at or before the expiration of three years. Also, after paying the above legacies and also my just debts, I give unto my brother Arthur Suter all and ever (every) part and parce (parcel) of the remaining part of my estate, viz: all every part & parcel of my land, also three negros: George, Sam & Simon, all my stock of horses, cattle, sheep & hogs, all my house hold & kitchen furniture & also all my moveable? estate of every kind and I do hereby disallow, revoke and disannull all & every other _________(faded out) and Testament Wills, legacies bequests & Executors by me in any wise before nam'd, will'd & hereinafter satisfying and confirming this and no other to be my Last Will and Testament. IN WITNESS whereof I have hereunto set my hand and seal this 28th day of April in the year of our Lord 1795? (the 5 is blurred) William Suter (seal) Sign'd, seal'd & acknowledg'd by said William Suter to be his Last Will and Testament in the presence of us: I also appoint my brother Arthur Suter and Nathaniel Edwards my Executors. Aaron Smith Jeremiah Innman Nathaniel Edwards Aaron Smith, Jeremiah Inman and Nathaniel Edwards made oath that they were present when the will & testament of William Suter, dec'd, was read to him for his approbation and before he sign'd and publish'd the same, he request'd that the interlineation in the words following to wit "all and every part and parcel of my land also" should be made that thereupon in order to give satisfaction to the said William Suter and if necessary to render the devise to Arthur Suter the more explicit, the said interlination was made before the said Will & Testament was executed by the said Testator. The aforesaid deponents further say that the said Will and Testament being is as aforesaid modified and enlarg'd for explanatory purposes and certainty the said William Suter was satisfied and pleas'd with therewith, and thereupon proceeded to execute and declare the said testament to which their names are affixed as his Last Will and Testament and that they subscribed their names thereto in consequence of such, his act and declaration and that the writing at bottom of said Will and Testament was noted and made before the execution of the same in manner & form aforesaid. Aaron Smith Jeremiah Inman Nathaniel Edwards At a Court held for the County of Southampton the 9th day of July 1795 The Last Will & Testament of William Suter was prov'd by the oaths of Aaron Smith, Jeremiah Inman & Nathaniel Edwards, the witnesses thereto & with a deposition of the said witnesses thereto annex'd, is ordered to be recorded, time being allow'd the Executors named in the Will to qualify thereto.
