SOUTHAMPTON COUNTY, VA - WILLS AND ESTATES - Jeremiah Tyler, 4 Feb 1789 --------------¤¤¤¤¤¤-------------- Wills: Jeremiah Tyler, St. Lukes Parish, Southampton Co, VA (1789) IN THE NAME OF GOD AMEN, I Jeremiah Tyler of the Parish of St. Lukes and County of Southampton being very sick of body tho of sound and perfect sense and memory do hereby make constitute and ordain this my last will and testament in manner and form as follows, viz: Imprimis: The land and plantation that I purchased of William Jarrell which I have not got lawfull title to and if he should asume to make a title when he arrives to the age of twenty one years, I desire that what money I have advanced to him toward paying of him for the said land may be received back into my estate and by my Executors laid out in the purchasing of another tract of land which is to be considered as part of my estate and for the use of my loving wife Elizabeth Tyler and my children, viz: William Jarrell Tyler, Martha Kinchen Tyler and the one my wife is now big with and after the death of my wife Elizabeth Tyler the land to be equally divided between my son William Jarrell Tyler and the one my wife is big with provided it should be a son but if it should be a daughter, for my son William to have the land forever. Item: I desire that all my just debts may be paid out of my estate and that my wife Elizabeth Tyler keep the remainder part of any estate of whatsoever kind in her possession for her to make use of as she may think proper for the maintenance of herself and family untill my son William Jarrell Tyler shall arrive to the age of twenty one years and then I desire that my whe? estate the land credited may be equally divided between my wife Elizabeth Tyler and what children I shall then have living and on the death of my wife Elizabeth Tyler I desire that her part may also be divided equally between my surviving children but if it should so happen that my wife Elizabeth Tyler should enter marry before my son William Jarrell Tyler should arrive to the age of twenty one years that then my will is that my wife Elizabeth Tyler have one third part of my estate during her natural life and the remainder part to be equally divided between my surviving children aforesaid. I lastly constitute and appoint my wife Elizabeth Tyler Executrix and my father Edmund Tyler Executor to this my Last Will and Testament. IN WITNESS whereof I have hereunto set my hand and affixed my seal this fourth day of February one thousand seven hundred and eighty nine.
