All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Joseph VICK (1762-1825), will dated 23 Aug 1825, proved 19 Sep 1825 In the name of God amen I Joseph Vick of the County of Southampton parish of Nottoway and state of Virginia being weak in body but of sound mind and memory do think proper to make and ordain this paper writing to be my last will and testament in manner and form following. to wit: Item: I lend unto my beloved wife Dorothy Vick all my lands lying on the west side of the road leading from Jerusalem to Smithfield together with all my personal estate of every kind whatsoever after all my just debts are paid until my son Joseph N Vick arrives to the age of twenty one years unless she should marry or waste be made in the same before that time then in either case I wish her to be putt to her thirds and should she live my widow until my son Joseph N attains to the age of twenty one years then my wish is that he shall receive one fifth part of my personal estate which may then remain into his possession as and for his legacy as my personal estate; my will and desire also is that my grist mill be reserved(?) out of the property lent to my wife and remain for her use for and during her single life and at her death or marriage I give the said mill to my son Joseph N Vick to him and his heirs forever. I also wish my executor hereafter named to reserve as much corn and pork as will be sufficient for the use of the family which may remain on the plantation for the Ensuing Year and then sell the remainder toward discharging my just debts. Item: I give and bequeath to my son Joseph N Vick all my lands lying on the south side of the road leading from Jerusalem to Smithfield and to be rented out for the purpose of repairing the house and said land and the balance if any to go to the use of my said wife and her children until my son Joseph arrives to the age of twenty one years or has a lawful heir. I also give and bequeath to my son Joseph N Vick after the death of his mother all my lands on the west side of the road leading from Jerusalem to Smithfield except that part called and known by the name of Adams Andrews and Ponds lands together with the one fifth part of my personal estate as before mentioned the personal estate to be received at his arrival to twenty one years and the land at the death of his mother to him and his heirs forever but should he die before he arrives to that __?__ or term my will is that all the property given to him descend to his four sisters if living and if not to each of them as may be living to them and their heirs forever to be equally divided between them Item: I give and bequeath unto my four daughters equally after the death of their mother say Margaret, Dorothy, Macy and Keturaby Vick all my lands called and known after and by the names of Adams Andrews and Pond. I also give to each of them one fourth part of my personal estate which may remain after their brother has received his proportion to them and their heirs forever. But should either of them die under age or without lawful issue my will is that their proportion descend to their then living sisters of the whole blood but should they all die without heir or under age my wish and desire is that their proportion descend to their brother Joseph N Vick to him and his heirs. I also give to my four daughters their single lives in the mansion house I now reside in. Item: My will and desire that my wife do educate my five youngest children out of the estate which I have lent to her. Item: I give and bequeath unto the heirs of Benjamin Vick one dollar each to them and their heirs forever. Item: I give and bequeath unto the heirs of Polly Pond one dollar each to them and their heirs forever. Item: I give and bequeath unto my son Jesse Vick the lands he has a deed for I also give to him one hundred dollars to be raised out of my estate two years after this will is admitted to record to him and his heirs forever. Item: I give and bequeath unto my son Daniel Vick the lands he has a deed for also one hundred dollars to be raised out of my estate at the end of Three years after this will is admitted to record to him and his heirs forever. Item: I give and bequeath unto my son John Vick the land he has a deed for also two hundred dollars to be raised out of my estate at the end of four years after this will is admitted to record to him and his heirs forever. Item: I give and bequeath unto my son Edwin Vick the land he has a deed for to him and his heirs forever. Item: My will and desire is that my executor do sell the following tracts of land: the Pair tree tract that I purchased of Thomas Pretlow and the Joiner tract near the mill also all the remainder of my estate not before disposed of of every kind whatsoever towards paying my just debts also to hire out some negroes such as are not easily controuled(sic) for the same purpose if required Lastly, I do hereby nominate constitute and appoint my friend Benjamin Griffin as my whole and sole executor to this my last will and testament revoking all other former wills by me made. Waddell At a court held for the county of Southampton on the 19th September 1825 this will was presented in court by Benjamin Griffin the executor therein named proved by the oaths of Peter J. Pierce, Elizabeth W. Waddell and Mary V. Waddell the witnesses thereto and admitted to record and on the motion of the said executor who made such according to law certificate is granted him for obtaining a probat thereof in due form as his giving bond and security whereupon the said Benjamin Griffin together with Carr Bowers and Allen Edwards his securities entered into and acknowledged a bond in the penalty of ten thousand dollars conditioned as the law directs.
