All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ John WHITFIELD (1770-1824), will dated 12 May 1823, proved 19 Apr 1824 I John Whitfield of the county of Southampton in the state of Virginia do hereby make my last will and testament in manner and form following, that is to say: 1st: I desire that my executors herein after mentioned do as soon as convenient after my decease have my estate appraised as aforesaid. I desire that my wife Polly Whitfield make choice of as much of the property as by said appraisement as to amount to the hundred dollars which property I give to my said wife and her heirs forever. I also loan to my said wife one third part of my lands for and during her natural life. The remaining part of my personal estate after my wife has taken the part therefrom as aforesaid I desire my executors sell off and of the money raised therefrom pay and discharge all my just debts, burial expenses and all the expense of the execution of this my will. 3rd: After the payment of my debts etc. as aforesaid that part of my personal estate which then remains I give to each of the following named persons an equal share of: to my daughter Matilda Bryant one third part of said residue, to my daughter Peggy Whitfield and one third part of said residue to my daughter Lucy Rodgers and the other third part of said residue to them my said three daughters and to each of their heirs forever. 4thly: I give to my son Benjamin Whitfield all my lands but never theless if my son shall die having no lawful begotten heir of his own body at my said sons death I give the lands which I now possess to be equally divided between my three daughters above named and to them and to their heirs forever. But if my said son should have any lawful begotten heir of his own body at his decease I give the said land and every part thereof to such heir and if my said son die leaving more than one child lawfully begotten of his body the land aforesaid to be equally divided amongst all such children and to be enjoyed by them and their heirs forever. Lastly: I do hereby nominate and appoint my son Benjamin Whitfield and Jacob Barnes executors of this my last will bearing date this 12th day of May in the year of our Lord 1823. John (his mark) Whitfield Witnesses Lewis Worrell Manry Maget Bennet K Whitfield At a court held for the County of Southampton on the 19th April 1824, This Will was presented in Court by Jacob Barnes one of the executors therein named Benjamin Whitfield the othe Executor refusing to take upon himself any part of the burthen of the execution thereof proved by the oaths of Manry Maget and Bennet K Whitfield two of the witnesses thereto and ordered to be recorded. And on the motion of Jacob Barnes who made oath according to Law Certificate is granted him for obtaining a probat thereof in due form on his giving bond Security whereupon the said Jacob Barnes together with Manry Maget and Exum Vick his Securities entered into and acknowledged their bond in the penalty of Three thousand dollars Conditioned as the law directs.
