All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Reuben WHITFIELD (1765-1817), will dated 28 Feb 1817, 12 May 1817 I Reuben Whitfield of the county of Southampton in the state of Virginia do hereby make my last will and testament in a manner and form following that is to say: First I desire my executors hereafter named do as soon as convenient after my decease have my personal estate appraised as the law directs. I then lend to my wife Pheba Whitfield two negro slaves named as follows: to wit Stephen and Jinney and said Jinney's future increase if any and such other of my personal estate as she my said wife may think proper to chose for and during the time that my said wife remains a widow and att the time of her marriage or death I give the same in the following manner that is to say, I give the negro woman slave named Jinney and all her future increase (if any) to my son Wilson Whitfield to him my said son and his heirs forever. I give the negro man slave named Stephen to my son William Whitfield to him my said son and his heirs forever. The remaining part of property lent to my wife as aforesaid I give equally to be divided amongst my five sons namely Benjamin Whitfield, Wilson Whitfield, Cordy Whitfield, George Whitfield, and William Whitfield to be enjoyed by my said sons and their heirs forever. I also lend to my said wife one third of all my lands for and during the term of her widowhood and no longer. I desire my executors have that part of my personal estate which my wife does not think proper to take as aforesaid immediately sold and out of the money raised by such sale pay my just debts and funeral expenses and if a surplus remain after paying my debts etc. as aforesaid I will the same equally to be divided amongst my five sons before named. I give to my son Wilson Whitfield the land and plantation whare on I now live and all my lands adjoining the same subject to my wifes thirds in addition to what has before been given him to him my said son and his heirs forever. I give to my son Benjamin Whitfield one tract of land known by the name of the Bucklow Land supposed to contain one hundred acres be the same more or less subject to my wifes thirds to him my said son and his heirs forever. I give to my son George Whitfield one tract of land known by the name of the Griffin Land Subject to my wifes third to him my said son and his heirs forever. I give to my son William Whitfield all my lands not before disposed of which lies in the state of North Carolina subject to my wifes third to him my said son and his heirs forever. Lastly I do hereby constitute and appoint my son George Whitfield and my friend Jacob Barnes executors of this my last will and testament in witness thereof I have hereunto set my hand and affixed my seal this 28th day of February in the year of our Lord on one thousand eight hundred and seventeen. Reuben (his mark) Whitfield Acknowledged and declared to be the last will and testament of the said Reuben Whitfield in presents of James Maget Benjamin Barnes John E Barnes At a court held for the County of Southampton the 19th day of May 1817 this will was proved by the oaths of James Maget, Benjamin Barnes and John E. Barnes who witnessed thereto and ordered to be recorded. And on the motion of George Whitfield one of the executors named therein who made oath thereto and together with Jacob Barnes and Benjamin Whitfield his securities entered into and acknowledged a bond in the penalty of three thousand dollars conditioned as the law directs certificate is granted the said George Whitfield for obtaining a probate thereof in due form the other executor therein named refusing to join in the probat.
