SOUTHAMPTON COUNTY, VA - WILLS AND ESTATES - John Whitehead, 8 Jul 1791 --------------¤¤¤¤¤¤-------------- IN THE NAME OF GOD AMEN, I John Whitehead of Virginia & County of Southampton being sick & weak in body but in perfect mind & memory and knowing it is appointed for all to die do make and ordain this my last will & testament as touching such worldly estate which it has pleased God to bless me with in this life, I give in the following manner & form: I give to my loving wife Meriam Whitehead one negro woman called Sylvia, also one horse & chair to her & heirs forever. I lend my wife Meriam Whitehead the plantation whereon I now dwell with all the land my grandfather bought of William Powers and two hundred acres joining Arthur Whitehead called the Nigh Piney woods and half the profits of the orchards my mother is now possesed with after the death of my mother, and two negros called Peter and David, one b..t (best?) feather bed & furniture, one half dozen cherry chairs, one pair tables and buffet with all the furniture in it during her natural life. In consideration of the maintenance and schooling of my children, I leave to my loving wife the use of all the residue of my estate both real and personal during life in widowhood or untill my eldest son shall arive to the age of twenty one years, two certain tracts of land which I shall direct to be sold, excepted, and then I give all my other lands to be divided amongst my sons Masimillan Whitehead, Lewis Augustus Whitehead, Jack Anthony Whitehead, Archer Mead Whitehead, Adolphus Whitehead, Samuel Murder Whitehead to be allotted & set apart to them by and at the discretion of my Executors or any two to them & their heirs forever. I leave my land in North Carolina, Gates County, which I purchased of James Parke & Benjamin Harrel to be sold by my Executors and a lawful title made the purchaser by a deed assigned by my Executors and the money arising from such sale to be applyed to the payment of my just debts and if the aforesaid land shoud (should) not be sufficient to pay my debts then my will and desire is that such a part of my land lying in Southampton which was granted my father by patent dated July one thousand seven hundred & seventy four may be sold as aforesaid that will be sufficient to pay all my debts or if my Executors shoud think it best to sell all the aforesaid tract, I hereby impower them so to do & to make a title to the same as aforesaid. I give the land which I have lent to my wife during her natural life to be equally divided amongst my sons as aforesaid to be alotted & set apart to them by and at the discretion of my Executors aforesaid to them & their heirs forever. I give to all my children (viz) Masimillan, Lewis, Augustus, Jack, Anthony, Archer Mead, Adolphus, Samuel Murder, Sally Miteldy Lucinday, Harret Whitehead all that part of personal estate which I have left my wife during her natural life to be their property at the (death) of my said wife. Also all that part of my personal estate left my wife during life in widowhood or until my oldest son shall arrive to the age of twenty one years to be their property at the expiration of either of the said terms to be allotted and set apart as aforesaid of two of my Executors shoud be then living otherwise to be divided by any three who my three eldest children shall chose to them and their heirs forever. I do appoint my wife Meriam Whitehead, Robert Jordan Sr, Hansel Bailey of Surry, John Maget & Samuel Maget of STon (Southampton?) County my hole and sole Executrix and Executors to this my Last Will and Testament revoking all other Wills by me before made. IN WITNESS whereof I, the said John Whitehead, hath hereunto set my hand and seal this 8 day of July in the year of our Lord one thousand seven hundred ninety one. John Whitehead (seal) Sign'd, seal'd, publish'd & declar'd in presence of: Jacob Laurence Samuel Maget At a Court held for the County of Southampton the 8th day of December 1791 This Will was presented in court by Meriam Whitehead, one of the Executors therein named, prov'd by the oath of Jacob Laurence, one of the witnesses thereto and continued for furthere proof, and on the motion of the said Executrix (time being given for the other) who made oath according to law, Certificate is granted her for obtaining a Probat thereof in due form giving security whereupon &c. And At a Court held for the County of Southampton the 10th day of October 1793 This was fully proved by the oath of Samuel Maget, another witness thereto and ordered to be recorded. Sam Kello, Cl.
