Hall (ejshall@email.msn.com) Page 523 Spotsylvania Co VA Minute Books At a Court held for Spotsylvania County on Tuesday August the first 1749 Present his Majesty's Justices John Waller Larkin Chew John Chew Joseph Hawkins Present William Wallor, __ John Spotswood Gent'l ============= The Last will and Testament of Henry Martin Dece'd being submitted In Court it Appears to this Court that John Martin an Infant the son of John Martin Dece'd is under the Age prescribed by Law to appear before This Court an heir at Law to the Dece'd to show Cause why this will Should not be proved And Edmond Waller being on this Occasion appointed His Guardian who Answered that he had no objection to offer against the Probate thereof in this Orphans behalf Then this Will was Proved by The Oaths of Martin True and Robert True, two of the Witnesses thereto And Jane Martin Benjamin Martin and Martin True the Exectors Therein named have Given bond and Taken the Oath in the Law Direct Certification in D___ form of Law is Granted them for obtaining Letters of Probate. And it is Ordered that Edward Herndon Thomas Hayden Wm Proctor and Charles Steward Senr or any three of them to Appraise all the Estate of the said Dece'd as Shall be shown them by the Executors [they being first Sworn before Some Majestrate of this County] and return their proceedings to the Next Court Will Book A, page 508 ___ the Name of God Amen, I Henry Martin of the County of Spotsylvania in Virginia being Sick in Body but of Perfect sence and Memory Thanks be to God for it I do hereby make and ordain this my last Will and Testament Revoking and making void all other Will or Wills by me heretofore ma__ and _____ my other just debts and _____ _____ Funeral ______ Paid I bequeath as followeth to wit: ---- I lend unto my beloved wife Jane martin all my Estate both Land & personal During her natural life Except one hundred Acres of land which shall in my said will hereafter mentioned ----- Item: I give and bequiath unto my son Benjamin Martin after the Death of my Loving Wife Jane Martin my land and Plantation Whereon I now live to be to him and his heirs forever ----- Item: I give and Bequeath unto my Grandson John Martin son to John Martin dece'd one hundred acres of Land whereon my son John Martin did Dwell to him and his heirs forever But in case my sd Granson John Martin should die without Lawful heir it is my will & desire that the said Land should be return to my sd _____ have given to my son Benjamin ------ Item: I give and bequeath unto my son Henry one Feather Bed & Furniture ------ Item: I give and bequeath unto my daughter Sarah True Wife to Martin True one Feather Bed & Furniture ------- Item: I give and bequeath unto my daughter Alice Moore Wife to John Moore one Feather Bed and furniture -------- Item: I give and bequeath unto my daughter Mary Robinson Wife to Michael Robinson one feather bed & furniture --------- And it is my will and desire that after the death of my loving wife Jane Martin that all my Estate after my above Land _____ legacies being first Taken out/ to be Equally divided among my ________ viz: Henry William Sarah Rose Benjamin Alice & Mary and it is my Desire that my still _____ should be in my sd Estate and be with be my said Estate be equally Divided among my above said Children and to their heirs forever. and lastly I do hereby Constitue and appoint my Loving wife my son Benjamin Martin and Martin True to be whole & sole Ext'r of this my last Will and Testament in Testimony I have hereunto set My hand & seal this 19th day Aprin in the year of our Lord 1748 his ------- Henry H Martin (Seal) his mark Martin x True mark Robert True (his mark was a large "H") Philip Vincent Vass
