SURRY COUNTY, VA - DEEDS - John Allen to Samuell Lancaster, 28 Aug 1712 --------------¤¤¤¤¤¤-------------- Deeds: John Allen-Samuell Lancaster, Southmark Twnship, Surry Co, VA INDENTURE BETWEEN JOHN ALLEN AND SAMUELL LANCASTER 28 AUG 1712 THIS INDENTURE made the 28th day of August in ye eleventh year of the reign of our sovereign Lady Anne by the grace of God of Great Brittain, Ffrance & Ireland, Queen Defender of the faith &c. in the year of our Lord one thousand seven hundred & twelve, between John Allen of the County of Surry, gentleman of the one part & Samuell Lancaster of the same county, planter of the other part. Witnesseth that the said John Allen for divers good causes & considerations him thereunto moving but more especially for & in consideration of the sume of six thousand pounds of good merchantable tobacco in sufficient cashe to him in hand paid by the said Samuell Lancaster at & before the ensealing & delivery of these presents, the receipt whereof & himself therewith fully satisfied, contented & paid, he doth hereby acknowledge. HATH given, granted, sold, Remised, Released, Aliened, Transferred, Enffeofed & Confirmed & by these presents for himself, his heirs & assigns he doth give, grant, sell, Remise, Release, Alien, Transfer, Enfeeoff & Confirme unto the said Samuel Lancaster & to his heirs & assigns forever, he being already in full & peaceable possession of the premises hereafter mentioned by virtue of a lease thereof made by the said John Allen unto the said Samuell Lancaster bearing date the day before the date of these presents all that right, title, interest, possession, claim & demand of him, the said John Allen, of in or to a certain tract or parcell of land scituate on the south side of the main Blackwater Swamp in the county aforesaid containing three hundred & fifty acres of land be the same more or less which said tract or parcell of land is part of a pattent formerly granted to James Allen dated the twenty fifth day of Aprill 1701 for fourteen hundred acres & by the said James given & bequeathed in his Last Will & Testament to the above named John Allen & his heirs forever (as relation to the said Will being had may more at large appear) bounded Viz: Beginning at the mouth of a branch on the south side of the Blackwater Swamp aforesaid (said branch divides this land from the land of Robert Lancaster, Jr) thence up the run of the said branch to a marked white oake stump standing in the head line of the said pattent on the north side of the said branch thence south two degrees & an half westerly a hundred & two pole to a red oake then south twenty seven degrees east a hundred & ten pole to a pine, then south fourteen degrees west a hundred & fourty six pole to a corner of Thomas Pitman's land & by the said Pitmans line east a hundred & sixty pole to the main Blackwater Swamp side aforesaid & up the various courses of the run of the said swamp to the begining. TOGETHER with all & singular the houses, orchards, gardens, woods, ways, & waters & all other royaltys, priviledges, proffits, commoditys & advantages whatsoever to the said tract or parcell of land belonging or in anywise appertaining or therewith or with any part thereof used, or enjoyed or accepted, reputed or taken as part or parcell or member thereof. TO HAVE AND TO HOLD the said tract or parcell of land and all & singular other the premises herein before mentioned & intended to be hereby granted, released & confirmed with their & every of there appurtenances unto the said Samuell Lancaster, his heirs & assigns forever to the only proper use & behoof of him, the said Samuell Lancaster, his heirs & assigns forever, to be held of our sovereign lady the Queen, her heirs and successors in free & common socage & not in capite or by Knights service. Yielding and paying the quit-rents due & accustomed to be paid for the same being one shilling yearly for every fifty acres to be paid at the feast of St. Michael, the Archangel. And the said John Allen for himself, his heirs, executors & admin-istrators doth hereby covenant, promise & grant to & with the said Samuell Lancaster, his heirs, & assigns that he the said John Allen, now at the time of the sealing & delivery of these presents is and stands lawfully & rightfully seized of all and singular the aforesaid tract or parcell of land of & for a good & indifizable estate of inheritance in fee simple. And that the said John Allen, his heirs, executors, & administrators the sold, hereby granted, premises with the appurtenances unto the said Samuell Lancaster, his heirs & assigns against all persons whatsoever shall & will warrant & forever defend & that it shall & may be lawfull for him , the said Samuell Lancaster, his heirs and assigns from time to time and at all times forever here-after peaceably & quietly to have, hold, occupy, possess & enjoy the same to his & their own proper use and uses & that clear & free from all & all maner of former & other gifts, grants, bargains & sales, mortages, joyntures, judgments, extents, & executions, & all other manner of encumbrance whatsoever. IN WITNESS of all which the partys first above named to these present Indentures have interchangably set their hands & seals the day and year first above written. John Allen sealed with a wafer Signed, sealed and delivered in the presence of: Henry Harrison William Browne At a court held at Southmark for the County of Surry August ye 20th 1712 This day appeared in court, the above named John Allen, & did acknowledge the above specified contents to be his reall act & deed which is ordered to be recorded & is recorded by: John Allen Cl. Cur. NOTE: Spelling is as shown on original. The word "indifizable" has been spelled "indefeazable" in other documents. Our current dictionary spells it "indefeasible" which means not capable of being annuled, voided or undone.
