All rights reserved. http://www.usgwarchives.net/copyright.htm TRIPARTITE INDENTURE ARTHUR ALLEN-SARAH BLAND & OTHERS (1707) THIS INDENTURE TRIPARTITE made the 19th day of November in ye sixth year of ye reigne of our sovereigne Lady Ann by ye grace of God of Great Brittain, France, Ireland & Virginia, Queen defender of ye faith &c: Anno Dom. one thousand seven hundred and seven (the document says "seven") between Sarah Bland of London, widow (relict & surviving Executrix of John Bland late of London, Merchant, deceased) of ye First part Arthur Allen of ye County of Surry in Virginia of ye Second part & Capt Thomas Holt, Mr. Joseph John Jackman, Capt Francis Clements & Mr Etheldred Taylor of Surry County in Virginia aforesaid of ye Third part. WITNESSETH that ye said Sarah for & in consideration of ye sum of five shillings to her in hand paid before the sealing and delivery hereof by ye said Arthur by ye hand of Mr.Micajah Perry, Mr. Thomas Lane and Mr Richard Perry of London aforesaid Merchants, the receipt whereof is hereby acknowledged hath demised, granted, bargained & sold and by these presents doth fully and absolutely demise, grant, bargain, and sell unto ye said Arthur his heirs & assigns all those plantation tract or devidend of land whereon Joseph Seath, Susanna Barnes, Edward Moreland, Robert Seath, Melchiradick Dutchee?, Michaell Ezell, George Peters and Edward Tanner now live scituate in Lawnes Creek parish in ye County of Surry aforesaid containing, by estimation, thirteen hundred acres by ye same, more or less, which said plantation tract or devidend of land is part of a Pattent for two thousand acres heretofore granted to Capt William Pearce of Mullberry Island and long since sold and conveyed by ye said Pearce to ye above named John Bland and to his heires and Administrators forever. Who by his Last Will and Testament gave & devised ye said land (inter alia) unto his wife ye above-named Sarah together with all & singular ye houses, orchards, gardens, woods, ways, and waters and all other royalties priviledges proffitts commodities & advantages whatsoever to ye said plantation tract or devidend of land belonging or in any wise appertaining or therewith or with any part thereof used or enjoyed or accepted reputed or taken as part parcell or member thereof. And ye reversion and reversions, remainder & remainders yearly and other rents houses and proffitts of all & singular ye said plantaion lands tenements & hereditaments & of every parts and parcell thereof. TO HAVE & TO HOLD the said plantation tract or devidend of land with all & singular ye premises hereby demised granted bargained & sold unto the said Arthur his Executors, Admistrators & assigns from ye day next before the day of ye date of these presents for & during ye terms of two years fully to be compleat and ended. Yielding and paying therefore to ye said Sarah her Executors, Administrators, and assigns on ye feast day of St. Michaell, the archangell, yearly, one ear of Indian corne if ye same shall be lawfully demanded. To ye intents ye by virtue of these presents and of ye statute for transferring uses into possession ye said Arthur may be in ye actuall possession of ye premises and be enabled to take and accept of a grant & release of ye reversion and inheritance thereof to him his heirs and assigns forever. AND THIS INDENTURE FURTHER WITNESSETH that said Sarah for ye better execution of these presents doth hereby nominate constitute and appoint ye said Capt. Thos Holt, Mr. Joseph John Jackman, Capt Francis Clements and Mr. Etheldred Taylor of Surry County in Virginia aforesaid joyntly and severally to be her true and lawfull attorney and attorneys for her in her namesstead & place not only to acknowledge thy present Indenture for ye Generall Court or of ye said Colony and Dominion of Virginia and in all or any other court or Courts of Record within that colony BUT to do and execute all and every other matter or thing by livery and seizin or otherwaies however for the better and more perfect execution of these presents and for conveying of ye said plantation lands and premises with the appurtenances unto ye said Arthur his heires & assignes forever. In witnesseth whereof the parties first abovenamed to these present Indenture Tripartite have interchangeably sett their hands and seals the day and year first above written.
