SURRY COUNTY, VA - DEEDS - Arthur Allen to Sarah Bland, 11 Oct 1704 --------------¤¤¤¤¤¤-------------- Deeds: Arthur Allen-Sarah Bland, Lawnes Creek Parish, Surry Co, VA TRIPARTITE INDENTURE BETWEEN BLAND- ALLEN-OTHERS (11TH OCT 1704) This Indenture Tripartite made the eleventh day of October Anno Dom.1704 and in this third year of the reign of our sovereign Lady Ann by the grace of God, Queen of England, Scotland, Ffrance and Ireland, defender of the ffaith &c. between Sarah Bland of the Liberty of the Tower of London, in the Kingdom of England, Widow (relict and surviving Executrix of John Bland late of London, Merchant deceased) of the First part Arthur Allen of Lawnes Crick in Surry County in the Colony and Dominion of Virginia, Merchant, of the Second part and Major Henry Baker of the Isle of Wight, County in Virginia aforesaid Colonell William Brown and William Brown Junior, his son, and Mr. William Edward, all of Surry County aforesaid of the Third part. WITNESSETH THAT the said Sarah Bland for and in consideracon (consideration) of the sum of five shillings of lawfull money of England to her in hand paid at or before the sealing and delivery hereof by the said Arthur Allen by the hands of Micajah Perry, Thomas Lane and Richard Perry of London aforesaid Merchants. The receipt whereof is hereby acknowledged hath bargained and sold and by these presents doth fully and absolutely bargain and sell unto the said Arthur Allen all that Mestuage or tenement and plantation of her, the said Sarah Bland, and all and every the lands of what nature or kind soever to the same belonging or anyways appertaining or therewith now enjoyed containing by the estimacon about two hundred acres, be the same, more or less, scituate lying and being in Lawnes Crick in Surry County in the said Colony and Dominion of Virginia now in the tenure or occupacon (occupation) of the said Arthur Allen and called by the name of Birtsneck and also all other the lands tenements and hereiditaments of her, the said Sarah Bland, scituate lying and being in Lawnes Crick aforesaid that are now in the tenure or occupacon of him, the said Arthur Allen (which said plantation lands and premises were heretofore lett by lease for a long terme of years by one William Pierce unto Major Arthur Allen, ffather of the said Arthur Allen, party hereunto, Haniball Ffletcher and William Byrt, of the yearly sum of six shillings and six capons and the inheritances thereof was afterwards purchased by the said John Bland, deceased, and by him in and by his Last Will and Testament given and devised (amongst other things) untohis wife, the said Sarah Bland, together with all and singular ediffices, buildings, barns, stables,tobacco houses, woods, timbers, orchards, gardens, ways, waters, watercourses, profitts,comodityies and appurtenances whatsoever to the said Mestuage tenement plantation lands and premises or any part thereof belonging or in any wise apportaining or therewith or with any part thereof used or enjoyed or accepted, reputed, taken, or known as part, parcell or myember thereof or of any part thereof and the revercon (reversion) and the revercons (reversions) remainder and remainders yearly on other rents issues and profitts of all and singular the said Mestuage or tenement lands and premises and of every part and parcell thereof. TO HAVE & TO HOLD the said Mestuage or tenement lands hereditaments and all and singular other the premises hereby bargained and sold as aforesaid and every part and parcell thereof, with the appurtenances, unto the said Arthur Allen, his Executors, Administrators and assigns from the day next before the day of the date of these presents for, during, and unto the full end and terme of one whole year from thence next ensuing and fully to be compleat and ended yielding and paying therefore unto the said Sara Bland, her Executors, Administrators and assigns the rent of one Indian corn upon the feast day of St. Michael, the Archangell (if the same shall be lawfully demanded) to the infant thereby virtue of these persons and of ye statute for transferring uses unto possession, the said Arthur Allen may be in the actual possession of the said premises and be enabled to take and accept of a grant and release of the reversion and inheritance thereof to him, his heires and assignes forever. AND THIS INDENTURE FURTHER WITNESSETH that the said Sarah Bland for the better executor of these presents doth hereby nominate, constitute and appoint the said Major Henry Baker, Colonell William Brown, William Brown Junior and William Edward joyntly and severally to be her true and lawfull attorney and attorneys for her in her namestead and place, not only to acknowledge the persons Indenture in the Generall Court of the said Colony and Dominion of Virginia and in all or any other court or Courts of record within that colony, but to do and execute all and every other matter or thing by livery and seizin or otherwise howsoever for the better and more perfect execucon (execution) of those presents and for conveying of the said Mestuage lands and premises with the appurtenances unto the said Arthur Allen, his heires, and assigns forever. IN WITNESS whereof the parties first abovenamed to these present Indenture Tripartite has interchangeably sett their hands and seals the day and yeare first above written.
