SURRY COUNTY, VA - DEEDS - Arthur Allen to Sarah Bland, 13 Nov 1707 --------------¤¤¤¤¤¤-------------- Deeds: Arthur Allen-Sarah Bland, Southmark Parish, Surry Co, VA INDENTURE TRIPARTITE BETWEEN ARTHUR ALLEN & SARAH BLAND & OTHERS (13 Nov) THIS INDENTURE TRIPARTITE made ye 13th day of November in ye sixth year of ye reigne of our sovereigne Lady Ann by grace of God of Great Brittain, France, Ireland & Virginia, Queen defender of ye faith &c. Anno Dom. 1707 between Sarah Bland of London, widow (relict and surviving executrix of John Bland late of London Merchant, deceased) of ye First part Arthur Allen of ye County of Surry in Virginia of ye Second part and Capt Thomas Holt, Mr. Joseph John Jackman, Capt Francis Clements and Mr. Etheldred Tayler, all of Surry County in Virginia, aforesaid of the Third part. WITNESSETH that ye said Sarah, for and in consideration of ye sume of one hundred pounds of lawfull money of England to her in hand paid at or before ye sealing and delivery hereof by ye said Arthur by ye hands of Mr. Micajah Perry, Mr Thomas Lane and Mr. Richard Perry of London aforesaid merchants. The receipt whereof she ye said Sarah doth hereby acknowledge and herselfe to be therewith fully satisfied and paid and thereof and therefrom doth clearly & absolutely acquitt, release and discharge the said Arthur, his heirs, executors, administrators & assigns forever HATH given, granted aliened and confirmed and by these presents doth fully and absolutely give, grant aliene, release and confirm to ye said Arthur (in his actuall posession now being) by force and virtue of a bargaine and sale to him thereof made for two years by Indenture bearing date ye day next before ye day of ye date of these presents and made or mention to be made BETWEEN the said Sarah of ye First part the said Arthur of ye Second part and ye said Capt. Thomas Holt, Mr. Joseph John Jackman, Capt. Francis Clements and Mr. Etheldred Tayler of ye Third part and of ye statute for transferring uses into posession and to his heires and assignes forever all those plantation and tract or devidend of land according to ye ancient bounds thereof,whereon Joseph Seats, Susanna Barnes, Edward Moreland, Robert Seats, Melchiradicko Dutchee, Michael Ezell, George Lectew? and Edward Tanner now live scituate in Lawnes Creek parish in ye County of Surry aforesaid. Conveying by estimation thirteen hundred acres be ye same more or less WHICH said plantation, tract or devidend of land is part of a pattent for two thousand acres heretofore granted to Capt William Pearce of Mullberry Iland (Island) and long since sold and conveyed by ye said Pearce to ye abovenamed John Bland and to his heires and assignes forever who by his Last Will and Testament, gave and devised ye said lands (inter alia) unto his wife ye above named Sarah together with all and singular ye houses, orchards, gardens, woods, ways, and water and all other royalties, priviledges, proffitts, commodities and advantages whatsoever to ye said plantation, tract, or devidend of land belonging or in any wise appertaining or therewith any part thereof used, enjoyed, accepted, reputed or taken as part, parcell or member thereof. AND ye reversion and reversions remainder and remainders yearly and other rents, issues and profitts of all and singular ye said plantation lands, tenements or hereditaments. TO HAVE AND TO HOLD the said plantation, tract, or devidend of land and all and singular other ye premises unto ye said Arthur Allen, party hereunto, his heires and assignes forever AND ye said Sarah for herself, her heires, executors and administrators doth hereby covenant, promise and grant to and with ye said Arthur, his heires, and assignes that she, ye Sarah, now at ye time ofye sealing and delivery of these presents is and stands lawfully and rightfully seized of all and singular ye aforesaid lands, tenements and hereditaments of and for a good lawfull and indefeazable estate of inheritance in fee simple. AND that ye said Sarah, her heires, executors and administrators, the said hereby granted premises with ye appurtenances unto ye said Arthur, his heires and administrators against all persons whatsoever shall and will warrant and forever defend and that it shall and may be lawfull for him, ye said Arthur, his heires and assignes from time to time and at all times forever hereafter peaceably & quietly TO HAVE HOLD OCCUPY POSSESS and enjoy the same to his and their own proper use and uses and ye clear and free from all and all manner and of former and other gifts, grants, bargains and sales, mortgages, joyntures, judgements, extents and executions and all other manner of incumbrance whatsoever. AND THIS INDENTURE FURTHER WITTNESSETH that ye said Sarah, as well for ye execution of these presents, as also for ye better conveying and assuring ye aforesaid premises unto ye said Arthur, his heires and assignes DOTH hereby nominate, constitute and appoint ye said Capt Thomas Holt, Mr Joseph John Jackman, Capt Francis Clements and Mr. Etheldred Tayler joyntly and severally to be her true and lawfull attorney and attorneys for her and in her namestead and place not only to acknowledge this present Indenture in ye General Court of ye Colony and Dominion of Virginia and in all or other courts or Courts of Record within ye Colony BUT to do & execute all and every other matter or thing thereto relating by livery & seizin or otherwaies howsoever. IN WITNESSETH of all with ye parties first above named to these present Indentures Tripartite have interchangeably sett their hands and seals the day and year first above written.
