SURRY COUNTY, VA - DEEDS - Arthur Allen to Benjamin Champion, 11 Feb 1723 ----¤¤¤---- THIS INDENTURE made the 11th day of February in the tenth year of the reign of our sovereign Lord George by the grace of God of Great Brittain, France and Ireland, King defender of the faith and in the year of our Lord one thousand seven hundred and twenty three BETWEEN Arthur Allen of the County of Surry, gentleman of the one part and Benjamin Champion of the same county of the other part. WITNESSETH that the said Arthur Allen for divers good cause and consideration him thereunto moving but most especially for and in consideration of the sum of six thousand pounds of good merchantable tobacco in sufficient casks to him in hand paid by the said Benjamin at and before the ensealing and delivery of the presents the receipt whereof and himself therewith fully satisfyed, contented and paid,, he doth hereby acknowledge. HATH given, granted, sold, remised, released, aliened, transferred, enfeeoffed and confirmed and by these presents for himself, his heirs and assigne he doth give, grant, sell, remise, release, enfeeoff and confirm unto the said Benjamin Champion and to his heirs and assigns forever, he being already in full and peaceable possession of the premises hereafter mentioned by virtue of a lease thereof made by the said Arthur Allen to the said Benjamin Champion bearing date the day before the day of these presents all that right, title, interest, possession, claim and demand of him the said Arthur Allen of in or to a certain tract or parcell of land situate on the south side of the main Blackwater Swamp in the county aforesaid containing five hundred acres of land, be the same, more or less, which said tract or parcell of land is part of a pattent formerly granted to James Allen dated the twenty fifth day of April 1701 for fourteen hundred acres and by the said James given and bequeathed in his Last Will and Testament to the above named Arthur Allen and his heirs forever (as relation to the said Will being had may more at large appear) bounded, viz: Beginning at a small s_____ gum by a w_____ on side on the south side of the main Blackwater Swamp aforesaid to a corner, Mr. Robert Lancaster's land) thence by Lancaster's line south southwest fifty? pole to a corner white oak? standing in the head line of the said pattent, thence north sixty nine degrees west one hundred and thirty two pole to a pine and north ______ degrees west one hundred and eighty six pole to a white oak, a corner tree of John Wall's land, then by Walls line north one hundred and ninety two pole to a gum by the side of the main Blackwater Swamp aforesaid, and down the various courses of the run of the said swamp to the begining. Together with all and singular the houses, orchards, gardens, woods, ways and waters and all other royaltys, priviledges, profits, commoditys and advantages whatsoever to the said tract or parcel of land belonging or in any wise appertaining or therewith or with any part thereof used or accepted, reputed or taken as part, parcell, in under thereof. TO HAVE AND TO HOLD the said tract or parcell of land and all and singular other the premises therein before mentioned to be hereby granted, released and confirmed with their and every of their appurtenances unto the said Benjamin Champion, his heirs and assigns forever to the only proper use and behoof of him the said Benjamin Champion, his heirs and assigns forever to be held of our sovereign Lord the King, his heirs and successors in free and common soccage and not in capite or Knights service yielding and paying (quit rents due and accustomed to be paid for the value being one shilling yearly for every fifty acres to be paid at the feast of St. Michael,) the Archangel. And the said Arthur Allen for himself, his heirs, executor, & Administrators doth hereby covenant, promise & grant to and with the said Benjamin Champion, his heirs and assigns that he, the said Arthur Allen, now at the time of the sealing & delivery of these presents, is & stands, lawfully and rightfully seized of all & singular the aforesaid tract or parcell of land of & for a good lawfull and indefeizable estate of inheritance in fee simple and that the said Arthur Allen, his heirs, executors & administrators, the said hereby granted premises with the appurtenances to the said Benjamin Champion, his heirs & assigns against all persons whatsoever shall & will warrant & forever defend, & that it shall & may be lawfull for him, the said Benjamin Champion, his heirs and assignes from time to time and at all times forever hereafter peaceable, to have, hold, occupy, possess, and enjoy the same to his & their own proper use & uses and that clear and free from all & all manner of former & other gifts, grants, bargains & sales, mortgages, joyntures, judgments, extents & executions & all other manner of incumberances whatsoever. IN WITNESS of all which ye partys first above named to these presents Indenture have interchangeable set their hands & seals the day & year first above written.
