SURRY COUNTY, VA - DEEDS - William Bridges to William Dancy, 20 Jun 1738 --------------¤¤¤¤¤¤-------------- Deeds: William Bridges-William Dancy, Southmark Parish, Surry Co, VA INDENTURE BETWEEN WILLIAM BRIDGES, WILLIAM DANCY & OTHERS (6-20-1738) THIS INDENTURE made this twentyeth day of Gune in the year of our Lord Christ one thousand seven hundred and thirty eight BETWEEN William Bridges of the County of Surry and Susanna, his wife, and Joseph Bridges of Burle Precinct in North Carolina of the one part and William Dancy of the said County of Surry of the other part. WITNESSETH that whereas the said William Bridges and Susanna, his wife and Joseph Bridges, by Indenture bearing date the day before the date hereof and for the consideration therin expressed have bargained and sold unto the said William Dancy, his executors, administrators and assigns one certain tract or parcell of land containing five hundred acres, more or less, lying and being on the north said of Nottoway River in the said County of Surry and bounded as in the said Indenture is mentioned. TO HAVE AND TO HOLD the said tract or parcell of land and all other the before granted premises with their and every of their appurtenances unto the said William Dancy, his executors, administrators and assigns from the day next before the date of the said recited Indenture unto the end and term of one year from thence next following to the patent that by virtue thereof and of the statute for transferring uses into possession, the said William Dancy might be in actual possession of the said land and premises and be enabled to take and accept of a grant and release of the reversion and inheritance thereof to him and his heirs to the use of him, his heirs and assigns for ever as by the said recited Indenture of lease more at large appeareth. NOW THIS INDENTURE WITNESSETH that the said William Bridges and Susanna, his wife and Joseph Bridges, for and in consideration of the sum of forty pounds currrant mony of Virginia to them or one of them in hand paid by the said William Dancy, the receit whereof the said William Bridges and Susanna, his wife, and Joseph Bridges to hereby acknowledge, have granted, remised, released and confirmed and by these presents do grant, remise, release and confirm unto the said William Dancy in his actual possession now have by virtue of the said recited Indenture of Bargain and sale made to him of a year and of the said statute and to his heirs and assigns for ever the aforesaid land and premises with the appurtenances and all the estate right, title, interest, claim and demand whatsoever of the said William Bridges and Susanna, his wife, and Joseph Bridges of in and to the same and every part thereof and of the reversion and reversions and remainder and remainders thereof and of every part thereof. TO HAVE AND TO HOLD the said land and premises with the appurtenances unto the said William Dancy, his heirs and assigns for ever to their only use and behoof of the said William Dancy, his heirs and assigns for ever and the said William Bridges and Joseph Bridges for themselves, their heirs, executors and administrators doth covenant and agree with the said William Dancy, his heirs and assigns that they and every of them the before hereby granted land and premises with the appurtenances will warrant and for ever defend against all persons whatsoever. IN WITNESS whereof the said William Bridges and Susanna, his wife and Joseph Bridges have hereunto set their hands and seals the day and year above written. his William Bridges Sealed and delivered mark, sealed with red wax in the presence of: her John Mason Susannah Bridges Francis Mason mark, sealed with red wax William Tenis Joseph Bridges sealed with red wax At a court held for Surry County January the 17th 1738 This day appeared in court the above named William Bridges and Joseph Bridges and did acknowledge the above mentioned contents to be their real act and deed and also Susannah, the wife of William Bridges having first privately examined appeared in court and relinquished her right of dower of in and to the above mentioned land and premises which is ordered to be recorded and is recorded by: John Allen, Cl. NOTE: The document was drawn up in Gune (June) of 1738 and presented in court in Jan 1738. It seems to me that the presentation in court would occur after June and should be 1739, however it clearly says "January 1738."
