SURRY COUNTY, VA - DEEDS - Blanks and Martha Moody to Thomas Wrenn, 24 May 1808 --------------¤¤¤¤¤¤-------------- Surry Co. VA Deed Bk. 3, pgs 340-342 FHLC #34119 This Indenture, tripartite, made this twenty fourth day of May in the year of Christ one thousand eight hundred and eight between Blanks Moody and Martha, his wife, of the first part, William Boyce of the second part and Thomas Wrenn of the third part all except Thomas Wrenn who is of Isle of Wight county of the county of Surry and State of Virginia: whereas the said Blanks Moody stands justly indebted to the said William Boyce in the sum of nine hundred eighteen dollars and ninety two cents -- four hundred fifty nine dollars and forty six cents, part thereof, will become due on the twenty fourth day of May in the year one thousand eight hundred and nine, the remainder of said debt being the like sum of four hundred fifty nine Dollars and forty six cents will become due on the twenty fourth day of May in the year one thousand eight hundred and ten: Now this Indenture witnesseth that the said Blanks Moody and Martha, his wife, in order to secure the payment of the said debt at the times & in the proportions herein before mentioned, for payment thereof, and in consideration of the sum of one dollar to them in hand paid by the said Thomas Wrenn at or before the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged, they the said Blanks Moody and Martha, his wife, have granted bargained and sold, and by these presents do grant, bargain and sell unto the said Thomas Wrenn all that tract or parcel of Land which the said Blanks Moody lately purchased of the said William Boyce, containing two hundred and fifty acres, be the same more or less, and the reversion and reversions, remainder and remainders, yearly and other rents, issues and profits thereof, and of every part and parcel thereof, and also all the estate, right, title, interest, trust, property claim and demand whatsoever both at Law and in equity of them the said Blanks Moody and Martha, his wife, in to or out of the said Lands, tenements, hereditaments and premises – To have and to hold the said tract of Land herein before mentioned to be hereby granted with their and every of their appurtenances unto the said Thomas Wrenn his Executors and administrators forever – upon trust nevertheless that this said Thomas Wrenn shall in the event of the said Blanks Moody his heirs, executors and administrators failing to pay the afore mentioned sum of four hundred and fifty Dollars forty six Cents on the aforesaid twenty fourth day of May in the year one thousand eight hundred and nine, shall as soon after as conveniently he can being required either by the said William Boyce his agent, Attorney, heirs, executors or administrators after having first advertised at Surry Court house and Isle of Wight Court House for the spate? of forty days the time and place of sale, proceed t o sell to the highest bidder for ready money, so much of the before mentioned tract of Land (to be laid off by the said Blanks Moody, his executors or administrators, and in case of the said Blanks Moody his executors or administrators failing to designate the part & a sufficiency thereof for sale to raise the sum due on the day appointed for such sale, it shall be lawful for the said Thomas Wrenn to sell such part of the said tract of Land he may think proper, sufficient to raise the sum then due) as may be necessary to pay every incidental charge attending the execution of this trust and the before mentioned sum of four hundred fifty nine Dollars together with the Interest that may have become due thereon – And also in the event of the said Blanks Moody, his heirs, executors and administrators failing to pay the other and like sum of four hundred and fifty nine Dollars & forty six cents (the balance of the within mentioned debt) on the aforesaid twenty fourth day of May in the year one thousand eight hundred and ten, shall, being required by the said William Boyce, his Agent, Attorney, heirs executors or administrators, proceed in like manner, as before provided, to sell so much of the Land, or remaining part thereof, as may be designated, as aforesaid, and be necessary to pay off the said sum of four hundred fifty nine Dollars & forty six cents together with the Interest that may have grown due thereon, as also all incidental charges attending the execution of this trust – It is farther covenanted & agreed by and between the parties to these presents that when the whole of the before mentioned debt shall be fully paid off together with all interest and costs that may accrue, either by the said Moody, his heirs, executors or administrators punctually paying the same or being raised by sale or sales executed under this trust, the said Land or the remainder thereof, if any (as may be) that then this thrust shall cease and be void to all intents and purposes. And the said Thomas Wrenn shall reconvey the said Land, or remainder, if any, as may be, to the said Blanks Moody or the person or persons whom Law & equity may, at the time, be entitled to the same. The said person or persons paying the expenses of such reconveyance . - - In Witness whereof the said the said parties have hereunto set their hands and affixed their seals the day and year first within written --- Signed, sealed & acknowledged Blanks Moody (seal) in presence of ----------- Martha Moody (seal) John Boya? Will Boyce (seal) Frederick Gray Thos Wrenn (seal) Robert Taylor At a court of Quarterly session held for Surry County May 24th 1808 The within written Deed of trust from Blanks Moody and Martha, his wife, to Thomas Wrenn trustee for William Boyce, was acknowledged by the said Blanks Moody and Martha, his wife, and Thomas Wrenn to be their act and Deed and as to them ordered to be recorded, and proved by the oath of John Boyce as to the said William Boyce and continued for further proof as to him the said William Boyce. The said Martha wife of the said Blanks Moody being privily examined by the Court agreeably to Law relinquished her right to Dower n the Lands conveyed by the said Deed, which is likewise ordered to be recorded - And at the same Court continued by adjournment & held for the said county the 25th day of May 1808. The said Deed was acknowledged by the said William Boyce to be his act and Deed and by the Court the same was also ordered to be recorded – Examined and deed delivered teste, Mr Thomas Wrenn John Faulcon C.S.C.
