I Nathaniel Berriman Senr. of Surry County in the State of Virginia being aged and weak in Body but of my sound mind & retentive memory thanks be Given to God for the same, do make, ordain, constitute & declare the following as my last Will and Testament, in manner and form following to wit, Imprimis I lend unto my son Nathaniel Berriman during his natural life, my tract of Land & plantation whereon I now live containing by estimation one Hundred Acres be the same more or less, it being all the land I now possess. And at the death of my son Nathaniel Berriman I give and bequeath unto my two grandsons namely, Edward Thomas Berriman & Robert W. Berriman, to be equally divided between them, the said Land & Plantation to them and their Heirs forever- Item I give to my son Nathaniel Berriman my family Bible to him and his Heirs forever-- Item The cattle, sheep and feather beds that I have heretofore given or loaned to either of my children or sons-in-law, and now in their possession, I give such property to the respectively- Item I give to my granddaughter Kezia Berriman Twenty dollars to her & her Heirs forever- [written along left margin of will] Item I give to my Item granddaughter Lucy Berriman Twenty dollars to her & her heirs forever- I give to my grandson George Berriman Twenty dollars to him & his Heirs forever- Item My Will & desire is, that my son Nathaniel Berriman and my son-in-law Thomas Rowell shall not pay any Interest on the notes which I hold against them- Item All rest, residue & remainder of my estate of every description whatever, I give & bequeath, to be equally divided between Sally Rowell, Polly Cocks, Lucy Rowell, Ann Rowell, & Nathaniel Berriman, to them & their Heirs forever. I wish the property given by this clause of my Will to be divided between my said Children, in kind, having regard to its value, as well as, cost to sute the wishes of my children, & not to be sold for the purpose of effecting a division. Item I hereby devise & direst that my estate shall not be appraises nor an Inventory returned to Court but merely a list made of the same & a valuation put on it to effect the division in the manner my said Children may choose, either by themselves or by the assistance of a friend or friends as may be preferred by them - This is to be entirely a private transaction between themselves. My Will & desire is, that my Executors shall not be held to security. Item The legacies given to my grandchildren namely Kezia, Lucy & George Berriman, I wish left in the hands of my son Nathaniel Berriman until they arrive to the age of twenty-one years. I hereby nominate and appoint my son Nathaniel Berriman and my son-in-law Thomas Rowell my Executors of this my last Will & Testament In Witness whereof I hereunto set my & affixed my seal this twenty fourth day of November in the year of Christ one thousand eight Hundred and twenty one. Berriman At a Court held for Surry County, March 25th 1822 The within written last Will & Testament of Nathaniel Berriman Senr. dec’d. was presented into Court by Nathl. Berriman junr. one of the Executors who made oath thereto according to Law, the same being proved by the oaths of the subscribing witnesses thereto is by the Court ordered to be recorded. The said Nathaniel Berriman entered into a Bond in the penal sum of One thousand dollars, conditioned for the faithful administration of the said Estate. Thomas Rowell another Executor appeared personally in Court & refused to take upon himself the burthen of the execution of the said Will.
