SURRY COUNTY, VA - DEEDS - James Minge to Thomas Holliday, 8 AUG 1712 --------------¤¤¤¤¤¤-------------- Deeds: James Minge-Thomas Holliday, Southmark Parish, Surry Co, VA INDENTURE BETWEEN JAMES MINGE AND THOMAS HOLLIDAY 8 AUG 1712 THIS INDENTURE made ye twenty-eighth day of August in the eleventh year of the reign of our sovereign Lady Queen Ann of Great Brittain &c. and in the year of our Lord Christ one thousand seven hundred & twelve between James Minge, the eldest son of James Minge deceased of the county of Prince George in Virginia of the one part & Thomas Holliday of the County of James Citty in Virginia of the other part. Witnesseth that the said James Minge for and in consideration of the sume of five shillings in currant mony of Virginia to him in hand at & before the sealing & delivery of these presents by the said Thomas Holliday well and truly paid and the receipt whereof he, the said James Minge, doth hereby acknowledge. HATH bargained & sold & doth by these presents bargain & sell unto the said Thomas Holliday his executors, administrators & assigns all that his tract or dividend of land containing five hundred & forty acres lying & being in the parish of Southmark upon Josephs Swamp in ye County of Surry & bounded as follows (to witt): BEGINNING at a live oak corner tree: standing in Robins Meadow near the mouth thereof & a little below a branch running out of it, thence up the dividing line of William Flandes north eighty six & one half degrees easterly one hundred seventy & three chains to a corner red oak standing in and 03? line thence along that line south five degrees easterly twenty six chains to a corner thence south thirty degrees easterly one hundred & fifteen chains to a forked black oak standing by a road commonly called Pidgeon Swamp Road north eighty two degrees westerly two hundred fifty & five chains to a corner white oak standing in a branch of Josephs Swamp then down this branch & up the watercourses of the said swamp to the mouth of the aforesaid meadow & up that meadow to the place where it first began at the said five hundred & forty acres of land being part of the fifth part of the boundaries laid out by Mr. John Allen, surveyor of Surry County for two thousand eight hundred & odd acres for the use of the deceased, the said James Minge & is laid off & surveyed at the request of the first above named, James Minge & granted to him by Pattent bearing date the twenty sixth day of Aprill Anno Domini one thousand seven hundred & twelve (as by the said Patent relation being thereunto had may more fully appear) all which said tract or parcell of land with all & singular the Mestuage tenements, hereditaments & appurtenances with all proffits, priviledges, commoditys & advantages whatsoever thereouts belonging or any wise appertaining with all the reversion & reversions, remainder & remainders thereof. TO HAVE & TO HOLD the said five hundred & forty acres of land with all woods, underwoods, swamps, marshes, low grounds, meadows, feeding pastures with all other hereditaments & appurtenances whatsoever unto the said Thomas Holliday, his executors, administrators & assigns from the day next before the date of these presents unto the end & term & for & during the term & time of one year from thence next ensuing to the intent by virtue thereof and of the statute for transferring uses into possession, the said Thomas may be in actual possession of the premises with the land tenements & appurtenances & be thereby enabled to take & accept of a Grant & Release of the inheritance thereof to him, the said Thomas Holliday, his heirs & assigns forever by one Indenture of Release intended to be made & executed by the said Minge to the said Holliday to bear the day after the date hereof to release, convey & transfer the rights, title & inheritance thence, to him, the said Thomas Holliday, his heirs & assigns forever. IN WITNESS whereof the said James Minge, first above mentioned to this Indenture hath sett his hand & seale the day & year first above written.
