Will of Silvanus Stokes Surry County, Virginia Wills, Deeds, Etc. 9, 1738-1754, pp 609-611 In the Name of God Amen I Silvanus Stokes of Surry County being in Health of Body and of sound & perfect mind and memory thanks be to God and Calling to Remembrance the Incertainty of this Life do make Constitute Ordain & Declare this my last Will and Testament in manner & form following. First I Bequeath my Soul and Spirit into the hands of Almighty God my Heavenly Father by whom of his (meer?) and only Grace I trust to be Saved and Received into Eternal rest through the Death and Spirit of my Saviour and Redeemer Jesus Christ my Body in hopes of a Joyful Resurrection I Commit to the Earth to be Buried with such Charges and in such place as my Executors shall think good. And as Touching the Distribution of my Worldly Estate I Dispose of the same as followeth Imprimis I will that all the debts I truly owe shall be paid Item I give and Bequeath unto my eldest son Jones Stokes my Plantation Grist Mill, Mill Stones Iron Work & all thereunto belonging with five hundred & sixty five Acres of Land and all Houses Fences Orchards & Appurtenances thereunto belonging being the Land whereon I now live and being the upper part for & During his Natural Life and after his Decease I give and Bequeath the aforesaid plantation and Land Mill and all the appurtenances aforesaid unto my grandson Jones Stokes son of my Natural Son Jones Stokes to hold to him the said Jones Stokes my Grandson his Heirs and Assigns forever. I also Give and bequeath to my said son Jones Stokes one Negro Man named Tony. Item I Give Likewise and Bequeath to my Eldest son Jones the Plantation whereon he now lives with near one hundred Acres of Land thereto belonging with Houses Orchards Fences and all other the appurtenances thereto belonging to him the said Jones Stokes his Heirs and Assigns forever and to and for no other Use Intent or Purpose whatsoever. Item I give and Bequeath unto my Second son Silvanus Stokes one Negro Man Named Dick, one Negro Woman Named Doll. Item I give and Bequeath to my Daughter Martha Ezell one Ewe Lamb. Item I give and Bequeath to my Granson Marcus Son of my son Silvanus four hundred Acres of Land being the Lower part of my land to hold to him the said Marcus his Heirs & Assigns forever. Item I give and Bequeath unto Silvanus Stokes Son of my son of Jones Stokes one Negro Boy named Solomon. Item My Will is that Hamlin Stokes Son of my Son Jones Stokes shall have the next Child the Wench Lucy bringeth and the Issue. Item I give & Bequeath to Jones Stokes son of my Son Jones Stokes one Negro Woman named Lucy with her Increase. Item I give and Bequeath to my Grandson Silvanus Stokes Son of my my Son Silvanus one Negro named Frank. Item I give and Bequeath to my granddaughter Agnes Freeman Daughter to my son Hamlin Stokes one Negro named Disho one named George. Item I Give and Bequeath to my Eldest Son Jones Stokes one Negro named Ben. Item I give and unto my granddaughter Agness Ezell one good Bed two Blankets one rug three Cows & three Ewes. Item I give and Bequeath unto my two sons Jones Stokes and Silvanus Stokes all the Remainder of Personal Estate moveable & Unmoveable to be Equally Divided between them and I do make Constitute and appoint my said two sons Jones and Silvanus to be whole & sole Executors of this my last Will & Testament Revoking Annulling and making Void all former Wills and Testaments by me at any time heretofore made Requiring them in the name of God to see this my last will & Testament performed as Witness my hand & seal this Eighteenth day of May one thousand seven hundred forty and two. Silvanus [his mark] Stokes Published & Declared by the said Testator as his last Will & Testament In presence of us whose names are hereunto Subscribed as Witnesses and then Attested by us in the presence of the said Testator Samuel Stokes John [the mark of] Stokes David Stokes At a Court held for Surry County the 21st day of March 1748. The aforewritten Last Will and Testament of Silvanus Stokes Deceased was presented in Court by Jones Stokes & Silvanus Stokes the Executors therein mentioned who made Oath there to according to Law and the same being proved by the Oaths of Samuel Stokes, John Stokes and David Stokes the Witnesses thereto was by the Court Ordered to be Recorded. And on the motion of the said Executors Certificate is Granted them for Obtaining a Probate thereof in due form.
