Persons or organizations desiring to use this material, must obtain the written consent of the contributor, or the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ************************************************************************ Contributed by Christie Canfield **************************************************************** This Indenture made this 25th day of Decr 1801 Between Etheldred Evans of Sussex County of the one part and James Davis of the aforesaid County of the other part Witnesseth that the said Etheldred Evans for and in consideration of the sum of one hundred and ninety pounds to her in hand paid or Secured by obligation before the sealing and delivering of this Indenture by the said James Davis the receipt whereof the said Etheldred Evans hath Granted bargained and Sold Aliened enfeoffed and by these presents doth grant, bargain and Sell Alien Enfeoff and Confirm unto the said James Davis his heirs and Assigns forever one Certain tract or parcel of Land Containing by estimation ninety Seven Acres (be the same more or less) Situate lying and being in the County of Sussex on the north side of Jeremy's Swamp and bounded as follows Vizt Beginning at a Corner black Gum in John Hamlins line on the side of sd Swamp thence along said Hamlins line to a corner popmonon tree in Anthony Evans line, thence along Anthony Evans line same course to a Corner pine in sd Evans's line & in William Wrens line, thence along Said Wrens line to a pine in Charles Hix's line, thence along sd Hix's line to the Mill pond a pine and thence down the main run of sd Mill pond including the Mill Seat and Also down the sd Swamp to the beginning or first station It being the one third part of the the land formerly the property of Benjamin Evans decd – and Also all trees woods underwoods Commons Common of Pastures profits Commodities Advantages Emoluments & Hereditaments whatsoever to the said tract or parcel of land above mentioned belonging or any ways appertaining or in or upon the same growing happening or Arising and Also the reversion and reversions remainder and remainders rents and Services of the said land and premises and of every part and parcel thereof and also all the estate right title Interest claim and demand whatsoever of him the said Etheldred Evans of in and to the said Premises and any part thereof To have and to hold all and Singular the said premises Above mentioned and every part and parcel thereof with the Appurtenances unto the said James Davis his heirs and Assigns to the only proper use and behoof of him the said James Davis his heirs and Assigns forever and the said Etheldred Evans for himself and his Heirs the said tract of land and every part thereof against himself and his heirs & against all & every other person & persons whatsoever to the said James Davis his heirs and Assigns Shall and will warrant and forever defend by these presents In Witness whereof I have hereunto Set my hand and Affixed my seal the day and year first above Written Signed Sealed – & delivered in the presence of us Etheldred Evans (Seal) Wm Wrenn Anthony Evans John Hamlin At a Court held for Sussex County the 5th day of August 1802 This Indenture was proved to be the Act and deed of Etheldred Evans the party thereto by the Affirmation of Wm Wrenn and oath of Anthony Evans two of the Witnesses thereto & ordered to by Recorded --- Teste James C.
