Persons or organizations desiring to use this material, must obtain the written consent of the contributor, or the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ************************************************************************ Contributed by Christie Canfield **************************************************************** This Indenture made this first day of February one thousand seven hundred and ninety eight - Between Davy Rix of Sussex County of the one part and William Wren of the aforesaid County of the other part whereas the Said Davy Rix is bound unto the Said William Wren by obligation Sealed with his Seal & dated the day & date hereof in the Sum of fifty pounds lawful Money of Virginia conditioned on the payment of twenty five pounds with Interest from the date hereof & whereas the Said Davy Rix is willing & desirous that the Said debt now due & owing shall be paid at the expiration of three years from this time to wit the first day of February one thousand eight hundred & one with the growing Interest thereon to be paid annually according to the term & effect of the Said bond without putting the Said William Wren his Heirs or Assigns to the trouble or expence of a Suit to recover the Same in case it should not be paid before - now this Indenture witnesseth that the Said Davy Rix for and in consideration of the promises at also for and in consideration of the Sum of five Shillings paid to him for which he hath passed a Receipt of this Date hath Bargained Sold Alien'd enfeoff & confirm'd & by these presents doth grant bargain and Sell Alien enfeoff and confirm unto the Said William Wren his Heirs and Assigns forever one certain tract or parcel of land lying and being in the County of Sussex containing by estimation fifty acres more or less and is bounded by William Wrens line on the one side and James Stanton & Joseph Rossers lines on the other sides together with the ????? & orchard Remainder & Remainders rents & services of the Said Land & premises and also all the Estate right title Claim & demand of him the Said Davy Rix of in & to the Said Land & premises and every part and parcel thereof to have and to hold the Said Land & premises with the appurtenances thereto belonging to the Said William Wren his Heirs & assigns the Said Davy Rix for himself & his heirs the aforesaid premises unto the Said William Wren his heirs & Assigns shall & will by these presents ??????? defend Upon ?????? truth & Confidence ?????????? & for the uses intents & purposes following that it is ??? that he the said William Wren his heirs Executor Adminr & Assigns may on the aforesaid first day of February on thousand eight hundred and one or at any time thereafter when he they or them shall think proper to possess himself or themselves of the before mentioned Land & premises herein & hereby convey it & being to posses'd shall & may on that day or at any time he may hereafter appoint Sell & dispose of the Same for ready money in hand dollars at six Shillings each & Gold at five Shillings & four pence the pennyweight until he shall gain out of the land the Sum of twenty five pounds with the Interest thereon from the date of these presents to the time of such Sail & after paying & satisfying the said Sum & Interest together with the expence of recording and preparing this Indenture the balance if any pay to the said Davy Rix his heirs or assigns -- In Witness whereof the Said Davy Rix hath hereunto set his hand and affixed his Seal the day & year before written Signed Sealed and acknowledged in the presence of his Joseph Sebrell Davy + Rix (Seal) Edwin Davis mark George Birdsong Drewry Lane James Stanton At a Court held in Sussex County the 3rd day of May 1798 This deed of trust was proved to be the Act and deed of David Ricks a party thereto by the Oath of Drewry Lane and the affirmation of Joseph Sebrell and James Stanton three Witnesses thereto and Ordered to be Recorded exd Teste MBailey Clk Sussex County VA, Deed Book I, pgs 191-192 FHLC #34167
