THIS INDENTURE made the Eighth day of January in the twenty Eighth year of the Reign of our Sovereign Lord George the second by the grace of God King of Great Britain France and Ireland King & Defender of the faith and in the year of our Lord Christ one thousand Seven hundred and fifty five. BETWEEN Samuel Stokes of the County of Sussex of the one part and John Stokes of the County aforesaid of the other part Witnesseth that the said Samuel Stokes for and in consideration of the sum of forty shillings of Lawful money of Virginia to him in hand paid by the said John Stokes before the sealing and Delivery thereof the Receipt whereof the said Samuel Stokes doth hereby acknowledge he the said Samuel Stokes hath Granted Bargained and sold Alien'd and Confirmed and by these presents doth Grant Bargain and sell Alien and Confirm unto the said John Stokes his heirs and assigns forever all this Tract or Parcel of Land Lying and being in the parish of Albemarle and in the County aforesaid Containing Seventy five Acres more or Less lying on the North side of the Rackoon swamp it being part of a pattent of Land Granted unto Silvanus Stokes Dated in one thousand seven Hundred and thirty two and is bounded by a line of David Stokes and a Line of John Stokes and by the water Courses of the Rackoon Swamp and all Houses Edifices Buildings Orchards Gardens Lands Meadows Commons Pastures feedings trees underwoods ways paths waters water Courses Easements profits Commodities advantages Emoluments and Heriditaments whatsoever to the said Tract or Parcel of Land belonging or in any wise appertaining and also all Estate Right title Reversion and Reversions Remainder and Remainders Rents and Services of all and Singular the said premisses and of every part and parcel thereof which the Appurtenances and also all Estate Right Title Interest Claim and Demand whatsoever of him the said Samuel Stokes of in and to the said Premisses and every part and parcel thereof TO HAVE AND TO HOLD the said Tract or parcel of Land and premisses above mentioned and every part and parcel of Land with the Appurtenances unto the said John Stokes his heirs and assigns to the only proper use and behoof of the said John Stokes his heirs and assigns forever and the said Samuel Stokes for him and his heirs the said Tract or parcel of Land and premisses and every part thereof against him and his heirs and against all and every other person and persons whatsoever to the said John Stokes his Heirs and assigns shall and will warrant and forever Defend by these presents IN WITNESS whereof the said Samuel Stokes hath hereunto put his hand and affixed his seal the Day and year above written. This Indenture and the Memorandum of Livery and Seisin thereof indorsed were Acknowledged by the thereto subscribed Samuel Stokes to be his Act and Deed and by the Court ordered to be Recorded.
