Deed of Trust - Anselm Sammons to Elizabeth Mason (Deed Book I, page 158, Sussex Co.VA.) This Indenture made this ninteenrh day of September one thousand seven hundred and ninety seven Between Anselm Sammons of the County of Sussex on the one part and Elizabeth Mason Executrix of Jno.Mason dec'd. of the said County of the other part. WHEREAS the said Anselm Sammons is justly indebted to the said Elizabeth Mason, Executrix as aforesaid in the just sum of one hundred and twenty one dollars and eighty cents, by his obligation of this date conditioned for the payment of sixty dollars and ninety cents which (Blank) sum the said Anselm Sammons is willing and desirious to pay and secure to the said executrix without putting her to the trouble of instituting a suit to recover the same. NOW THIS INDENTURE therefore witnesseth that the said Anselm Sammons for and in consideration of the premises as also for consideration of one dollar to him in hand paid the receipt whereof he doth hereby acknowledge hath and by these presents doth grant bargain and sell unto the said Elizabeth Mason one certain tract or parcel of land lying and being in the said County of Sussex containing fifty acres be the same more or less it being the land the said Sammons purchased of William Finch as per deed which will appear by referring to the Records of said County of Sussex to the only proper use and behoof of her the said Elizabeth Mason her heirs and assigns forever, and the said Anselm Sammons for himself and his heirs the said tract or parcel of land & premises against himself and his heirs and against the claim of all and each other person or persons whatsoever unto the said Elizabeth Mason shall and will warrant & forever defend by these presents. UPON TRUST & CONFIDENCE and to and for the following intent and purpose, to wit that if the aforesaid sum of sixty dollars and ninety cents shall remain unpaid on the twenty fifth day of December one thousand seven hundred and ninety eight, it shall be lawful for the said Elizabeth Mason to sell at public sale the within mentioned land and premises for ready money having given the said Anselm Sammons twenty days previous notice of such sale and ____ of the money arising from the sale thereof pay and satisfy the within (Blank) sum of sixty dollars and ninety cents, with the interest thereon accruing and the expense of recording this present Indenture and the overplus if any remain shall pay and return to the said Anselm Sammons his heirs Executors or administrators.
