Court Decree - Sammons etc. vs Sammons (Deed Book V, page 539, Sussex Co.VA.) In Sussex County Court December Term 1855 Sammons etc. vs Sammons In Chancery This day this cause was docketed by consent of parties, and came on to be heard on the bill answer replication thereto. exhibit filed and argument of counsel. on consideration whereof the Court doth adjudge order and decree, that Henry M. Magee, Jos. T. Sammons either of whom may act who are hereby appointed comr. for this purpose after giving ten days previous public notice of the time and place of sale, sell to the highest bidder on the premises, on a credit until 1st day of October 1856 (except cash sufficient to pay expenses) Take of the purchase 4 Bonds of equal amounts, and pay over one bond to Allen Sammons, one bond to Jos. T. Sammons one to James L. Sammons & one to Charles W. Sammons. The Comr. will report to Court. A Copy Teste A.M.Orgain D.C. In obedience to a Decree of Sussex County Court December Term 1855 we have proceeded to sell the land of Wylie Sammons dec'd. named in the said decree upon a credit till the first day of October 1856 for the sum of Three hundred and forty dollars. And paying the expenses and the commissions which amounts to twenty nine dollars & eighty cents, which leaves a balance of three hundred and ten dollars & twenty cents, which leaves the sum of seventy seven dollars & fifty five cents due to each legatee, we have one bond executed by Allen Sammons and Jas. L. Sammons to Jos. T. Sammons for his part one other bond executed by the same to the W.D. Taylor Guardian for Charles W. Sammons for the same amount. We have Allen Sammons receipt, and J.L. Sammons for the same amount. All which is hereunto respectfully submitted by us. H.M. Magee Jos. T. Sammons At a Court Held for Sussex County on the 7th day of May 1857. The report of the Commissioner in this cause having been returned one month and no exception thereto being filed the Court doth confirm the same and doth adjudge order and decree that the same be made final between the parties and this the said report recorded. Sammons commissioners appointed by the County Court of Sussex December Term 1855, To sell the land of Wylie Sammons dec'd. and Allen Sammons and James L. Sammons Witnesseth that in consideration of the sum of Three hundred and forty dollars do grant unto the said Allen and James L. Sammons etc. The said tract or parcel of Land containing by estimation one hundred and sixty acres be the same more or less. And bounded as follows By the Land of Joseph H. Parker, James Key of the state of Alabama, Thomas E. Tatum and John L. Dobs The said commissioners convey only such title to the said Land as an indicated is as Commissioners appointed to act under a decree of the said Court of Sussex.
