Deed - Thornton, Robinson & Applewhite to Z.W.T. Mitchell (deed Book 1, pages 636 & 637) This deed made this 4th day of April 1872, between R.E. Thornton Trustee of the first part, Robt.H. Robinson & Mary E. his wife of the second part Z.W.T. Mitchell of the third part & Thos.H. Applewhite of the fourth part witnesseth: that whereas by Deed dated the 8th day of April 1872, of record in the Clerks Office of the County Court of Sussex Co. the said Robt.H. Robinson granted,conveyed to the said R.E. Thornton Trustee the tract of land hereinafter described In Trust to secure the payment of an Execution from the County Court of Sussex County against the said Robt.H. Robinson as surviving obligor of himself & Danl.C. Robinson decd in favor of Thos.H. Applewhite assignee of George T. Murrell amounting to 15-49-47 at the date of said deed and whereas the parties interested in said land have effected a private sale thereof to the said Z.W.T. Mitchell, which is satisfactory to all the parties above interested, as appears by their becoming parties to this Deed & signing & acknowledging the same and whereas Mary E. the wife of Robt.H. Robinson did not join in said Deed of trust, but is now willing to relinquish her contingent right of dower therein as appears by her joining in this deed & signing & acknowledging the same. Now this Deed Witnesseth that in consideration of the sum of Eight hundred & fifty Dollars by the said Z.W.T. Mitchell paid (t)he said Robt.H. Robinson & Mary E. his wife & the said Rich.E. Thornton trustee do grant unto Z.W.T. Mitchell the following real Estate to wit: all that certain tract or parcel of land lying in the County of sussex & State of Virginia on the Green Church Road bounded on the north by lands of Lyem Hill on the East by lands of Mrs Susom Bass,on the South by lands of Susom Bass & others on the West by lands of Jno Winfield containing Three hundred & ninteen acres be the same more or less being the property mentioned in the above recited conveyance and the said Richard E. Thornton covenants that he will warrant specially the property hereby conveyed & the said Robt.H. Robinson covenants that he will warrant generally the property hereby conveyed & that the said Mitchell shall have quiet possession of the said land free from all encumberance and it is further agreed by & between the said Robt.H. Robinson Thomas H. Applewhite & Rich.E. Thornton that the said sum of Eight hundred & fifty dollars shall be applied to the credit of the debt aforesaid & the said Thos.H. Applewhite releases the land hereby conveyed from all liability for the debt aforesaid.
