Persons or organizations desiring to use this material, must obtain the written consent of the contributor, or the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ************************************************************************ Contributed by Christie Canfield **************************************************************** This Indenture made this 3rd day of December in the year of Christ one thousand eight hundred & twenty one, between Elijah Wren of Sussex County & State of Virginia of the first part & Lydia Wren of the aforesaid County & State of the second part, & James Dillard of Said County & State of the third part make Known & attest that the Said Elijah Wren in order to provide for & Secure the payment of a debt of three hundred dollars on demand the 25th day of December next in Six Separate bonds of fifty dollars each, one one for the benefit of Julia Wren, one for Deborah Wren, one for Mary Wren & one for William Wren one for Anna Wren, & one for Lydia Wren Junr heirs of William Wren decd to all which Said bonds the first aforesaid Lydia Wren Stands bound as Security & for & in consideration of the Sum of one dollar by the Said James Dillard to the Said Elijah Wren in hand paid, he the Said Elijah Wren has aliened bargained & Sold & by this Indenture does bargain Sell alien, enfeoff & Confirm unto the Said James Dillard & to his heirs & assigns forever one certain tract or parcel of land lying & being in the Said County of Sussex Containing by estimation one hundred & Seventy five acres be the Same more or less bounded by the lands of Said Lydia Wren , Joseph Rosser, Thomas Blunt, George Norsworthy & others it being a tract of Land bought by the Elijah Wren when Sold by Commissioners under a decree of the County Court of Sussex for the benefit of the heirs of William Wren decd reference being had to an order bearing date the 24th of Jany 1821 the boundaries will more fully appear, To have and to hold the Said tract of land to the Said James Dillard & to his heirs & assigns forever, but upon this Special trust & for the following purposes to Wit that if the Said Elijah Wren his heirs executors &C shall fail to pay & Satisfy Said bonds as herein named, on or before the 25th day of December eight hundred & twenty two with Such interest as may be due thereon or any time thereafter when required by the Said Lydia Wren in order to exonerate herself from the Securetyship thereof then in Such case the Said James Dillard, his heirs Exrs &C Shall & they are hereby authorized at any time after the 25th day of Decr 1822 when required by the Said Lydia Wren, her heirs exrs &C in order to raise money Sufficient to discharge the Said bonds or so much of them as may be then due to Sell at Auction for ready money or immediate payment the Said tract of land hereby conveyed to him for the purpose aforesaid & defraying the expenses of Such Sale with the cost of this Indenture & to apply the money arising therefrom accordingly & should there be any Surplus of money arising from Such Sale after paying Said debts herein named it Shall be paid to the Said Elijah Wren his heirs or assigns and the Said Dillard Shall make to the purchaser a title absolute & Sufficient in law, but of Such Sale ten days previous notice Shall be given by advertisements thereof in writing at some Public places in Said County of Sussex not far from the residence of Said Elijah Wren and the Said Elijah Wren for himself his heirs, exrs &C Covenants with the Said James Dillard his heirs & assigns form & against the claim & demand of all & every other person or persons whosoever, In Witness whereof the parties have hereunto Set their hands & affixed their Seals the day & year first herein Written. ------- Teste Elijah Wren (Seal) Thomas Chappell as to Dillard also Lydia Wren (Seal) Henry Briggs for Elijah Wren James Dillard (Seal) Saml Phillips On the 2nd day of May 1822 This Indenture was proved as to Elijah Wrenn by the Oaths of Henry Briggs and Saml Phillips and as to James Dillard by the Same two Witnesses as also by the Oath of Thomas Chappell a third Witness and recorded in the Clerks office of Sussex County Court. – Examd.
