Court Decree & Related Papers - Sammons vs Sammons Infants (Loose Court Papers, Sussex Co.VA., 1754-1870, Reference 1823-154) To the County Court of Sussex in Chancery sitting Humbly complaining your orators Allen Sammons Willie Sammons Nathaniel Sammons beg leave to show the Court that Hardy Sammons departed this life the (blank) day of (blank) in the year (blank) intestate seized and possessed of a tract of land containing one hundred and sixty four acres lying and being in the County aforesaid that your orators and Gilliam Sammons Nathaniel Sammons Lotta Sammons and Temperance Sammons (the latter of whom are infants of tender years) are his children and legal heirs and as such entitled to his land but so it is may it please the court inasmuch as three of the children are infants of tender years and your orators are without remedy except at common law they in tender consideration whereof they pray the Court to make the said infants by James Seaborne their special guardian appointed by the Court to defend them in this suit defendants to this bill and compel him full and perfect answer to make to the the allegations therein contained and further order and decree that the said tract of land of which Hardy Sammons died seized be sold inasmuch as it of less value than three hundred dollars to each share of the heirs of the said Sammons and the proceeds be equally divided between the heirs of the said Sammons and your comptts(?) and grant such other and general relief the premises considered as equity may dictate and as in duty bound your orators well ever pray etc. Shands(?) The answer of James Seaborn special guardian of Gilliam Sammons Lotta Sammons and Temperance Sammons infant heirs of Hardy Sammons dec'd. November Court 1822 Sussex County to wit, In Chancery Allen Sammons, Willie Sammons, Nathaniel Sammons, Plaintiffs} Against} James Seaborn Special Guardian of Gilliam Sammons Lotta Sammons and Temperance Sammons infant heirs of Hardy Sammons Dec'd...Defendants} This day this cause came on to be heard on bill and answer whereupon the Court doth order Judge and decree that Wm.B.Mason David Grizzard Wm.Whitehorn Jr. and Wm.Whitehorn Sr. or any three of them be appointed Commissioners to carry the following decree into effect and that they after having advertised the tract of land in the Bill mentioned proceed to sell the same at public auction for the best price they can obtain and take a bond from the purchaser or purchasers to each of the adult heirs of the said Hardy Sammons in the bill mentioned for one equal sixth part, to Willie Sammons a bond for one equal sixth part to Allen Sammons for one equal sixth part to Nathaniel Sammons a bond for one equal sixth part and deliver the said bonds to the said Willie Allen & Nathaniel Sammons and return the bonds taken to the infants defendants Gilliam Sammons, Lotta Sammons, and Temperance Sammons for one equal sixth part to the Clerks office of this County to be delivered to the said infants when they arrive to legal age or to their order or to any Guardian hereafter appointed for them and make report to this Court in order to a final decree. In obedience to an order of the worshipful Court of Sussex to us directed bearing date November Court 1822 We the Commissioners have proceeded to sell the lands belonging to the Estate of Hardy Sammons Dec'd. for the sum of Eight hundred and sixty four Dollars and seventy Eight Cents and have divided the proceeds into six Equal Shares and assigned unto each of them the sum of one hundred & forty four Dollars thirteen cents. Given under our hands this 6th day of March 1823 and pray the Court to receive the above as our Report.
