IN THE NAME OF GOD AMEN I THOMAS CAIN of the County of Sussex being sick and weak of body but of perfect mind and memory do make and ordain this my last Will and Testament in manner and form following first and chiefly I recommend my soul into the hands of Almighty God who gave it me hoping through the death and merit of his Son to find favour in the sight of God. Item - It is my will and desire that all my just debts may be paid off, and the remainder part of my estate to be disposed of as I shall hereafter mention. Item - I lend and bequeath to my loving wife Mary Cain my plantation in Sussex and improvements thereon during her widowhood also one negro man Peter one negro woman Milly one negro boy Davy one negro Girl Cresy with the use of all my stock and furniture. Item - At the death of my widow I give the whole of my estate real and personal to my loving son Ellison Chappell Cain and his heirs forever; should my son die without heir my will and desire is that my brothers and their heirs should have the whole of my estate real and personal to them and their heirs forever. Item - It is my will and desire that my brother Isham Cain shall act as executer to this my last Will and Testament revoking all other Wills gifts grants made or done by me heretofore; given under my hand and seal this second day of November eighteen hundred and two. Thomas Cain (Seal) Witnesses- Geo. Rives Joshua Hawthorn At a Court held for Sussex County the 3rd day of February 1803. The Last Will and Testament of Thomas Cain decd. was presented into Court and proved by the oath of Joshua Hawthorn one of the witnesses thereto and ordered to be recorded. And at another Court held for said County the 5th day of May 1803 Mary Cain appeared in Court and renounced all benefit of claim made her by the Will of her deceased husband Thomas Cain, and claims the provisions made in such cases by an act of assembly, and on motion of said Mary Cain administration with the Will annexed is granted her who made oath and gave bond and security according to Law Certificate is granted her for obtaining a probate thereof in due form.
