I Thomas Ezell Sen'r. of the parish of Albemarle In the County of Sussex being sick and weak in body but of perfect mind and sound memory thanks be to almighty God but calling to mind the uncertainty of Life do make and ordain this my last Will and Testament in manner and form following to wit, I give and bequeath to my beloved Son Abel Ezell the Land and Plantation whereon I now live to him and his Heirs forever but in case he should die without Heir then it is my desire that the said land and plantation be sold and the profits arising be divided between my two Sons Frederick and Balaam Ezell. Item. I give and bequeath unto my Son Balaam Ezell one feather Bed and Furniture. Item. All the rest of my Estate I lend unto my beloved wife Anne Ezell during her Life or Widowhood but all my just debts are to be paid out of the Legacy bequeathed unto my said wife but after her decease the hole to her lent to be equally divided Between all my children. Lastly I nominate and appoint my two Sons William & Abel Ezell to be Executors of this my last Will and Testement hereby revoking all other Wills and Bequeaths by me heretofore made, In Witness whereof I have hereunto set my hand and affixed my seal this twenty fourth day of October in the year of our Lord Christ one thousand seven hundred and Eighty. The last Will Testament of Thomas Ezell dec'ed. was exhibited Court by Abel Ezell one of the Executors therein named proved by the oaths of Lewis Underwood and Henry Jarratt witnesses thereto and ordered to be recorded and on the motion of the said Executor who made oath according to Law and with Thomas Newsum and Nathaniel Newsom his Securities entered into and acknowledged their Bond in the penalty of one thousand pounds conditioned as the Law directs Certificate is granted him for obtaining a probat thereof in due form.
