IN THE NAME OF GOD AMEN I Timothy Ezell of the Parish of Albemarle in the County of Sussex being aged and infirm, but of perfect, sound and disposing Sense and memory do make and ordain this my last Will and Testament and first of all I bequeath my Soul unto God, hoping at the general Resurrection, to have that reunited to my Body and with both to enter into eternal Happiness, purchased by my dear redeemer JESUS CHRIST, through whose Merits alone I hope for salvation. My Body I desire may be buried in a Christian like manner, according to the descretion of my Executor hereafter mentioned and as touching what Worldly goods it hath pleased Almighty God to bestow upon me, them I dispose of in manner and to the persons following, vizt. after my debts and Funeral charges are paid. First I give unto my Son George Ezell two Hundred and ten acres of Land be it more or less, lying and being on a Branch of the Poplar Swamp called and known by the name of the Sightwood Branch in the County of Sussex, to him and his Heirs forever. Also I give and bequeath unto my Daughter Lydia Ezell one Feather bed & furniture as it now stands: also a Chest weaving Loom with its appurtenances, one spinning Wheel and Cards, & one leather Trunk. Also I give unto my Son Timothy Ezell one large Pot. Also I give unto my Son Thomas Ezell all my Coopers Tools; to my Son John Ezell all my wearing apparel and also to each of my said Sons Thomas and John, and to John Gilbert, the several Debts which each of them respectively owes to me. Also I give unto my Son George Ezell one half of my estate of whatkind soever not hitherto Bequeathed. Also I give unto my Wife Mary during her natural life the use of the other half of my Estate and after her decease my Will is that; that half of my Estate the use whereof is hereby given to my Wife, may be equally Divided amongst my Daughters, Elizabeth Gilbert, Lydia Ezell and Mary Rove. Lastly I do appoint my Son George Ezell Executor of this my last Will and Testament IN WITNESS whereof I hereunto set my hand & affix my Seal this (Blank) Day of (Blank) In the year of our Lord one Thousand seven Hundred and fifty nine. Timothy(his mark)Ezell (LS) Signed Sealed published & declared by the said Timothy Ezell as his last Will and Testament in presence of- Edward Eppes Daniel Eppes Richard Wiggins At a Court held for Sussex County the 15th Day of August 1760. The afore Written last Will and Testament of Timothy Ezell deced. was presented in Court by George Ezell the Executor therein named who made Oath thereto according to Law, and the same was proved by the oaths of Edward Eppes and Richard Wiggins two of the witnesses thereto and by the Court ordered to be Recorded.
