Will of Adam Ivey (Will Book E, page 342, Sussex Co.VA.) IN THE NAME OF GOD AMEN I Adam Ivey of the County of Sussex being of sound and perfect mind & memory thanks be to Almighty God, and calling to mind the certainty of death & uncertainty of this transitory life, do make constitute & ordain this my last Will and Testament in manner following, That is to say first I recommend my Soul into the hands of Almighty God who gave it me hoping for Salvation in and thro' the Mediation of my Blessed redeemer Jesus Christ and my Body, I commend to the earth to be decently buried in Christian burial at the discretion of my executors hereafter named and as to the worldly Goods the Lord hath been pleased to bless me with I give and dispose of as follows. That is to say First I give & bequeath to my loving Son Ephraim Ivey & to his Heirs & assigns the tract or parcel of Land whereon he lives being one hundred Acres. Also I give and bequeath to my loving Son Peebles Ivey the land & plantation whereon he now lives being one hundred and Ten Acres, be it more or less & is a part of the Tract of Land I purshased of Joel Maclemore having reserved about forty Acres to the plantation whereon I now live and to be disposed of hereafter which said Land I give to my Son Peebles & to his Heirs and assigns I also give to my said Son my great Gun. Also I lend unto my loving Wife Mary Ivey during her natural life the land & plantation whereon I now live so as to include about forty Acres Reserved out of the tract of Land I bought of Joel Maclemore the whole containing two hundred and twenty five Acres be it more or less, I also lend unto my said loving wife all my stocks of Cattle, Horses, Hogs & Sheep all my Household & Kitchen furniture and all my Crop & plantation, Utensils,and all other articles of my estate not hereafter particularly by me disposed of be it of what nature, kind or Quality soever. And at my said Wifes death I give and bequeath all the personal estate that may be found remaining to my three loving daughters namely Millie Prince wife of Nicholas Prince if she shall survive her said Mother to Winnie Ivey wife of Henry Ivey & to Christian Ivey & in case of the death of either of my said three Daughters before their said Mother then the Children of each or either of my said Daughters so dying shall be intitled to & Receive the share part or proportion of the said estate that their Parent would have received if they were then living so as I now consider my Daughter Christian Iveys Children in the same view as the child or children of my other Daughters. Also I do hereby consider that having provided in a reasonable a manner as my circumstances will admit for my loving Son Samson Ivey & consented to him disposing of the land I fully intended for him to his Brother Aron Ivey I do declare that I do not make any further gift or devise for him or to him. Also I give and bequeath to my loving son Aron Ivey & to his assigns the Land & plantation whereon I now live, Including the forty Acres reserved out of the tract or parcel of Land I purchased of Joel Maclemore so as to contain two hundred & twenty five Acres be it more or less & is the Land lent unto my loving Wife for life the possession to be given unto my said Son his Heirs or assigns at my Wifes death & not before or any part thereof but by her consent, I also give my said Son Aron my small Gun. AND LASTLY I do hereby make, constitute and appoint my loving sons Ephraim Ivey and Aron Ivey executors of this my Last Will and Testament hereby revoking all other Wills & bequests by me heretofore made & declaring this & no other to be my said last Will & Testament In testimony whereof I have hereunto set my hand & affixed my Seal this 3rd day of August in the year of our Lord One thousand seven hundred and Eighty nine. David Mason At a Court held for Sussex County the 7th day of May 1792 The last Will and Testament of Adam Ivey deceased was presented into Court by Ephraim Ivey and Aron Ivey the executors therein named the same was proved by oaths of Gilliam McLemore and Burwell McLemore two of the Witnesses thereto and ordered to be Recorded and on the motion of the said executors who with Thomas Newsome and Joseph Prince their securities entered into Bond with the Penalty of five thousand pounds conditioned as the Law directs whereupon a Certificate is granted them for obtaining a probat thereof in due form.
