IN THE NAME OF GOD AMEN I John Malone of the County of Sussex being sick & weak tho' of perfect sense & disposing mind & memory and calling to mind the uncertainty of this transitory life and knowing it is appointed for all Men Once to die do make and Ordain this my last Will & Testament in the manner and form following. Imprimis. I give my Soul into the hands of my redeemer JESUS CHRIST trusting to his Mercy for the forgiviness of all my Sins and as for such Worldly Goods as it hath pleased God to bless me with in this life I give and dispose of the same in the manner and form following. Item. My just debts being first paid I dispose of the remainder of my Worldly Goods in the following manner. Item. I lend unto my beloved wife Mary during her natural life the Land and plantation whereon I now live with the following Negroes great Jacob, Frank great Pegg little Pegg Sall Patt Beck and Peter to enable her my said wife to raise my younger children to the age of twenty one years also for the better support maintenance and education and at the decease of my said wife the said several Slaves lent to my wife as aforesaid to be equally divided among my several children as then shall be living to them and their Heirs forever with fifty pounds lawful money to be paid unto my Son Thomas Malone at the death of my beloved Wife aforesaid. Item. I give and bequeath unto my Son William Malone the Land whereon he now lives which is the one fourth of the Land I now hold with one Negro man called Bob and one feather Bed & furniture to him my said William and to his Heirs and assigns forever. Item. I give and bequeath unto my son John Malone Two hundred and Twenty five Acres of Land lying on one or both sides of Sappony Creek with one Negro man called Jacob and one feather bed & furniture to him my said son John Malone & to his Heirs & assigns forever. Item. I give and bequeath unto my son Thomas Malone two hundred and twenty five acres of Land lying between Booths Bonners & Harpers lines with one Negro boy called Prince one Horse one feather Bed & furniture to him my said Son Thomas Malone & to his Heirs and assigns forever. Item. I give and bequeath unto my Son Daniel Malone the remainder of my Land being the place whereon I now live on the North side of Sappony Creek at the death of my beloved Wife with one Negro boy called Robin one Horse one feather Bed & furniture to him my said Son Daniel Malone and to his Heirs & assigns forever. Item. I give and bequeath unto my Daughter Elizabeth Malone one negro Girl called Judy one feather Bed & furniture to her and to her Heirs and assigns forever. Item. I give and bequeath my water Grist Mill on Sappony Creek to my four Sons Wm. John Thomas & Daniel Malone jointly & severally between them and to their Heirs and Assigns forever. I do appoint my Son William Malone executor to this my last Will & Testament revoking and disannuling all other Wills by me heretofore made. Oliver Thomas Parham George Parham At a Court held for Sussex County the 6 day of February 1794. The last Will and Testament of John Malone decd. was presented into Court by William Malone the executor therein named the same was proved by the Oaths of the subscribing Witnesses & Ordered to be recorded. On motion of said Executor who made Oath according to Law and with John Huson & Thomas Parham his Securities entered into Bond in the penalty of 2000 L Conditioned as the Law directs Certificate is granted him for obtaining a Probate thereof in due form.
