IN THE NAME OF GOD AMEN I James Philips of Sussex County being sick and weak in body but of sound mind and memory do this Fourteenth Day of February One thousand seven Hundred and Eighty two make and appoint this my last Will and Testament in manner and form following that is to say. 1. It is my will and desire that my land and plantation shall be rented out until my oldest son Samuel Phillips shall arrive to the age of twenty one years and the profits arising from the said land to be equally divided among my three children Samuel Henry and George Phillips and when my said son Samuel Phillips shall arrive to the age of twenty one years that then he shall have the land and plantation and pay his two brothers George and Henry Phillips two thirds of the value of the said land and plantation when they shall arrive to the age of twenty one years the said land I give to my son Samuel Phillips to him and his heirs forever. 2. It is my will and desire that my three beds and furniture shall be equally divided by appraisement between my three children Samuel Henry and George Phillips. 3. The remaining part of my Estate of what kind or quality soever shall be sold, and the money arising from the said sale after my just debts are paid, shall be equally divided between my three children above named. 4. It is my desire that if either of my said children should dye before the come of age or marry's that then his part of the estate shall be equally divided between the other two. 5. I do hereby appoint and constitute my brother Thomas Phillips and John Nicolson Executors of this my last Will and Testament. In witness whereof I have hereunto set my hand and seal the day and year above written. The last Will and Testament of James Phillips deced. exhibited in Court by Thomas Phillips one of the Executors therein named proved by the oath of Harris Nicholson and the affirmation of a quaker viz't. John White witnesses thereto and ordered to be recorded and on the motion of the said Executor who made oath according to law and with Harris Nicholson & john White his securities entered into and acknowledge their bond in the penalty of two thousand pounds conditioned as the law directs Certificate is granted him for obtaining a probat thereof in due form.
