Will of James Sammons (Will Book C, pages 400,401,402, Sussex County,VA.) IN THE NAME OF GOD AMEN I JAMES SAMMONS of Albemarl Parish in the County of Sussex being very sick and weak of body but of perfect sence and memory do make this my last will and testament in form and manner as followeth I give and bequeath my soul to God which gave it to me and my body to the Earth from whince it came to be decently buryed at the discretion of my Executors &c. ITEM I give and bequeath unto my Son JAMES SAMMONS and to his heirs & assigns for ever the plantation whereon he now lives lying and being on the North side of a new chopt line begining at Thos. Avents corner tree thence a straight corse to a Mulberry tree on the side of John Morgans Mill pond Also I give unto my said son one bay mare which he has now in his possession to him and his heirs for ever. ITEM I give and bequeath unto my Son BENJAMIN SAMMONS and to his heirs and assigns forever one bed and furniture. ITEM I give and bequeath unto my Daughter PATTY SAMMONS and to her heirs and assigns forever one bed and furniture my loom slays & harnesses and it is my desire that my said Daughter should have my wifes saddle to be given up at any time before or at my wifes death, as my said wife shall think proper. ITEM I give and bequeath unto my Son TIMONTHY SAMMONS and to his heirs & assigns for ever one bay colt by the name of Peacock also I give my said Son TIMOTHY My saddle and bridle one sow and piggs one ewe and lamb one feather bed and furniture one small pott and pott- hooks one small pewter dish one large pewter bason and two peuter plates and it is my will and desire that my wife shou'd keep his proportion of my estate with her and maintain him while he arives to age of twenty one years and in case he shou'd not live while he arives to the age of twenty one years then I give the whole of his portion heretofore mentioned to my Son BENJAMIN and my Daughter PATTY SAMMONS to be equally devied betwen them to them and there heirs and assigns for ever. ITEM I lend unto my loving wife NANNY SAMMONS dureing her life the plantation whereon I now live on the South side of the above mentioned new chopt line and after her decease I give and bequeath the afforesaid land to my sons BENJAMIN & TIMOTHY SAMMONS and to their respective heirs and assigns forever and in case either shou'd dye without ishue then it is my will and desire that the one living shall posses the whole of the above mentioned land on the South side of the new chopt line I also lend unto my loving wife my whole estate not herein before mentioned or intended to be given away be it of what nater kind or quallity soever dureing her life and after her decease I give and bequeath the said estate or so much of the same as there shall be remaining unto my children to wit, JAMES, BENJAMIN, TIMOTHY, PATTY SAMMONS and to my Daughter BETTY WHITEHORN to be equally divided betwen them to them and their heirs forever also I appoint my wife and my Son BENJA. The last Will & Testament of JAMES SAMMONS deced was exibited in Court by BENJAMIN SAMMONS one of the Executors therein named proved by the oaths of THOMAS AVENT & JOHN SLEDGE two of the witnesses thereto & ordered to be recorded & on the motion of the said Executor who made oath thereto according to law & with LITTLEBERRY MASON his security entered into & acknowledged their bond in the penalty of Ten thousand pounds conditioned as the law directs Certificate is granted him for obtaining a probat thereof in due form.
