IN THE NAME OF GOD AMEN I Robert Tucker of Sussex County being in perfect sence and disposing mind & memory and calling to mind the uncertainty of this transitory life do make and ordain constutute & appoint this my last Will & Testament in the manner and form following viz: IMPRIMIS I give and bequeath my soul to almighty God that gave it and what Estate it hath pleased God to bless me with in this life I dispose of the same in the manner & form as followeth. ITEM. I give and bequeath unto my loving wife Mary Tucker my whole Estate both real & personal during her natural life or widowhood and at her decease or intermarriage my whole Estate lands etc. to be sold for the best price that may be had and the money arising therefrom, to be equally divided among my children that then shall be living, to them & each of them and their heirs forever. ITEM. I constitute and appoint my friend Richard Harrison ___r. of Dinwiddie County my whole & Sole Executor of this my last Will & Testament, leaving it to his option to dispose of any part of my Estate as he shall think proper either at private or public sale for the payment of my debts and funeral expences and confirming this and no other to be last Will & Testament. IN WITNESS whereof I have hereunto set my hand & seal this 19th day of March one thousand seven hundred and seventy eight. Robert Tucker (LS) Sealed Published & Declared by the Testator to be his last Will & Testament in our presence- Henry Jones George Parham Reuben Malong At a Court held for Sussex County the 16th day of September 1779. The last Will & Testament of Robert Tucker deced. was presented in Court & proved by the oaths of Henry Jones & George Parham Witnesses thereto and ordered to be recorded & the Executor therein named refusing to take upon him the burthen of the Execution thereof on the motion of Mary Tucker who made oath according to law & with Richard Harrison & Henry Jones her securities entered into & acknowledged their bond in the penalty of five thousand pounds conditioned as the law directs, Certificate is granted her for obtaining letters of administration of the said Estate with the said Will annexed.
