TAZEWELL COUNTY, VA - COURT - William Vance vs. William Thompson, Executor of James Thompson, deceased (Partial File) --------------¤¤¤¤¤¤-------------- Tazewell Co, VA Chancery Court Index No. 1825-003 [Rebuttal of defendants reply] William Vance vs. William Thompson, executor of James Thompson, dec'd In chancery For replication to the defendants answer The complainant says that his father was tried twice for the murder of Horton and that at the first trial the said James Thompson did appear for him and before the first trial the complainant executed his obligation to the said James Thompson for eighty dollars, date the 4th day of April 1818, which is here with exhibited and prayed to [be] taken as part of this replication which this complainant paid to the James Thompson--and after trial the said James Thompson refused [to] appear for the father of the complainant unless he would execute the note or obligation in the bill mentioned, and before the second trial of the father this complainant, the [said] James Thompson became sick and unable to attend at the second trial of the father of this complainant and did not appear, and this complainant says all the other allegations in the bill are true==and this he is ready to verify wherefore Gent [undreadable] by Deft--- [Order for depositions from witnesses] The Commonwealth of Virginia to the John Cecil and William Smith Gentleman Justices of Tazewell County Greetings, Know ye that we trusting to your fidelity and provident circumspection, in deligently examining John Brown, William Romines, & al witness as well on behalf of William Vance Plaintiff as William Thompson Exer of James Thompson Decd Defendant, in a suit now depending in the County Court of Tazewell, we command you or any tow or more you that on such certain day and at such certain places as you shall appoint you assemble yourselves and the sitesses aforesaid before you, you call and cause to come, and dilegently examin on the Holy Evangelist of Almight God, and then examinations into our said Court distinctly and plainly without delay you send and certify encosed returning also to us this writ witness John Crockell Clerk of our said Court at the Court House the 23th [sic] day of March 1824 [signed] John Crockell Clk The Commonwealth of Virginia the Constable of the lower district in the County of Tazewell Greeting You are hereby Commanded to summons John Brown, Lewis Horton & William H.
