The evidene established the fact that the JOHNSONS and MCFALL provoked the difficulty which resulted in the killing. John MCFALL was shot and killed by Harold WILBURN near the latter's home on Johnson's Branch in the Stony Ridge section of the county last Sunday evening about 6:30 o'clock. A preliminary hearing was held here Wednesday and it was established at the trial that Brack JOHNSON, has son, and Cliff MCFALL and two others were drunk and disorderly at the time of the killing. So far as brought at the trail there was no motive on the part of WILBURN for committing the offense other than the defense of his brother, Paul WILBURN, who was being attacked by the JOHNSON's and MCFALL. Paul WILBURN encountered the men on a narrow road, and a row was started for no apparent reason. WILBURN, outnumbered, retreated, and was later joined by his brother. The drunken men again appeared near a road entering the Johnson place and renewed the fight. It was stated they had knives and endeavored to cut Paul WILBURN who defended himself with a plank he picked up in the road. He knocked one of the men down and in the effort he fell himself, and while recovering from the fall MCFALL attempted to cut him with a knife. Harold WILBURN, about ten or fifteen feet distant, saw his brother's predicament and fired a shot in the ground near the men. The shot had no effect in stopping the fight and when MCFALL made another attempt to cut WILBURN his brother fired a shot that brought an end to the row. The bullet lodged in MCFALL'S stomach, from which he died a short time afterwards. The Sheriff testified that the JOHNSON'S were drunk when they were arrested a short time after the shooting. The WILBURN'S were sober and had no previous difficulty with the JOHNSON'S. Fred LAMBERT, of Graham, was defendant in a domestic relations case in Judge Albert PEERY'S court Wednesday. The plaintiff in the case was a lady whom LAMBERT knew well. LAMBERT got drunk one too often. He went to the home of his lady friend, and is alleged to have broken a window in an effort to gain entrance. He retreated from the scene immediately afterwards being induced to do so because of a shot the woman fired in his direction. LAMBERT defended himself well, and there appeared to be no ill feeling between them. LAMBERT was given five months in the county jail, receiving a credit for the time he had already served.
