All rights reserved. http://www.usgwarchives.net/copyright.htm ==================================================================== Clinch Valley News May 17, 1940 The jury trying the damage case of "Gobler" SAYERS against Mrs. Ed PEERY for alleged felonious assault, returned this verdict: "We, the jury find no damages in this case worthy of consideration for either party." The case grew out of the Bennett trial, in which SAYERS was a witness. Twenty or more indictments for felonies were made by the grand jury, which reported Tuesday afternoon in Judge BUCHANAN'S Circuit Court. The jury was composed of M.H. KISER, foreman; Jesse S. GILLESPIE, L.B. CRAWFORD, John H. BANDY and Pete TIZENS. These are indictments: Brack JOHNSON, Clifford JOHNSON, Daniel SMITH, James B. BOWLING, W.J. RHINEHART, Bert LOWE, Clifford JOYCE, Edward YATES, Ben DAVIS, Clarence HELBERT, John HAGSON, Arthur NEWMAN, Walter LESTER, Tom COMPTON, R.C. SMITH, John W. LIDDLE, Adam GILLESPIE, Frank CRIGGER, Ernest CRIGGER, Melvin DAWSON, Jack HOUCHINS. The Bennett case, which resulted in a jury disagreement at the last term of Circuit Court, is on the docket for hearing May 21st. Trial Justice appeal cases will be heard May 28th and 29th. The MATNEY case, Mary Anne and her husband, Jim, was heard before Judge BUCHANAN Tuesday afternoon. The husband brought suit for the custody of his two children and for a reduction in the alimony of $25.00 per month which he was required to pay as a result of recent divorce proceedings. It developed that MATNEY was several hundred dollars behind in fines in Tazewell, assessed against him for transporting liquor, and was also injured in the mines at Red Jacket recently. Judge BUCHANAN permitted the two children to remain in the custody of their mother, and reduced MATNEY'S monthly alimony to $20.00 per month. Fred COMBS, of Grundy, represented MATNEY and J.P. ROYALL appeared for Mrs. MATNEY. Sutherland and Sutherland, lawyers of Grundy, brought action for damages against the Virginia Hardwood Lumber Co., of Tazewell. The lumber company was represented by George C. PEERY, V.L. SEXTON, Jr., and CROCKETT and GILLESPIE. The case was postponed until Friday, the postponement being due to an alleged discrepancy in the serving of the notice on the lumber company. The elder Sutherland and R.O. CROCKETT desired a change in the date of the trial because of a meeting of the Republican State convention in Roanoke, the gentleman stating that this meeting has as its objective the saving of the country, but they stated that possibly the country might be saved at some other time in view of the fact that the witnesses had been summoned for Friday in the damaged case. The jurors in the civil cases this week were Walter J. BENBOW, Dennis CASSELL, S.T. JACKSON, Sam LEECE, Jesse W. VERNON, Sam G. MCCALL, Umber J. HANKINS, J.H. HUFFMAN, John B. MUTTER. The jury was excused Tuesday afternoon until Friday morning. Mrs. J.N. JOHNSON, of Tazewell, announces the marriage of her daughter, Miss Reba, to Mr. Sam HASTAM. The marriage occurred on Friday, May the tenth at Houston, Texas. The bride has been a teacher in the Texas school for a number of years. POUNDING MILL ------------------------------ Rev. Curtis JONES, Christian minister, will preach here Sunday night. Rev. Curtis HANKS preached Saturday and Sunday nights on Quarry Hill and will preached again next Saturday and Sunday nights. Mother's Day prize to the oldest mother was given to Mrs. W.B. STEELE; Mrs. Finley RINGSTAFF for having largest number of children present there were six. Richard LOWE is building a room to Mr. and Mrs. C.T. COLLIN's dwelling. Mr. and Mrs. Ted LUTTRELL and four children, of Indian, spent Sunday her with parents, Mr. and Mrs. John BOOTHE. Miss Lettie RINGSTAFF is not so well today. The census taker visited Pounding Mill Tuesday. Mr. and Mrs. C.H. ROBINETTE and son, David, were guests Sunday of Mr. and Mrs. Samuel ROBINETTE and son, Dannie, of Belfast. Mr. and Mrs. S.T. SPARKS had all of their children home for Mother's Day; Mr. and Mrs. A.R. SPARKS, Richlands; Mr. and Mrs. Billy Mac SPARKS and daughter, of Caretta; Mr. and Mrs. Sterling ONEY, of Princeton, West Virginia and Miss Vivian Roanoke. Mr. and Mrs. Raymond JOHNSON of Bluefield, West Virginia, spent Mother's Day with parents, Mr. and Mrs. J.H. JOHNSON. Mrs. W.E. MULKEY left Sunday for Beckley, West Virginia, to visit her daughter, Mrs. Sereal TURNER, and Mr. TURNER. Mr. and Mrs. Alfred PILKINS visited Mrs. PILKINS mother, Mrs. Eveline PILKINS at Cliffield Sunday. Mrs. PILKINS is some better and is up some. Misses Hazel and Maria HILT spent the weekend with their mother, Mrs. Maggie HILT at Tannersville. Miss Ruth is teacher here and Miss Marie bookkeeper for Quarry. Mr. and Mrs. Tom MULKEY and Dolores and Carl RINGSTAFF were shopping in Bluefield Saturday. Mrs. W.B. STEELE is spending a few weeks with her daughter, Mrs. John B. GILLESPIE and Mr. GILLESPIE and Miss Catherine, came on Tuesday. Miss Beatrice JOHNSON has returned home after a two weeks visit with her sister, Mrs. C.H. THOMAS and family. GRATTON ------------------------------ T.E. BURTON and family, of West Graham, spent the day at the home of W.R. COMPTON, Sunday. T.E. returned same day, Thomas spent Sunday night and Monday at home of Mr. and Mrs. M.L. BURTON, his brother. Mrs. M.L. BURTON and sisters, Rosa and Ella and Mrs. BURTON'S mother, Mrs. HAGER, motored to Bluefield, West Virginia Saturday. Thelma JONES, Thompson Valley, spent the weekend at her uncle's M.L. BURTON. Mr. and Mrs. M.L. BURTON spent Tuesday in Thompson Valley with Mrs. BURTON'S parents, Mr. and Mrs. W.H. HAGAR. S.W. BOURNE remains critically ill at his home here. Mr. and Mrs. Howard BOURNE spent Sunday with Mrs. BOURNE'S parents, Mr. and Mrs. GREGORY in Bland County. Bilton and Sam BURTON were home for the weekend. Mr. and Mrs. Eugene BURTON are moving back to Tazewell.
